CouncLlmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 96-04- A RESOLUTION APPROVING THE ISSUANCE OF PERMIT BASEI} ON FINDINGS OF FACT # AND PERMIT TO GRADE AND EXPORT SOILS A CONDITIONAL USE DECLARING TERMS OF WHEREAS, the Ramsey City Council adopted Resolution No. adopting Findings of Fact # for ~s use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFQRE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On ) , 1996, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Good Vidue Homes, Inc. ("Permit Holder") for grading operations on the property legally described as follow.~: The North Half of the Northwest Quarter of Section 27, Township 32, Range 25, Anoka County, Mi~_ nesota, EXCEPT the following described tract: That part off the Northwest Quarter of the Northwest Quarter of said Section 27 described as follows: COmmencing at the Southwest comer thereof; thence north 00 degrees 33 minutes 47 seconds We~st on the West line of said Northwest Quarter of the Northwest Quarter for a distance of 418 feet; thence North 89 degrees 26 minutes 44 seconds East and parallel with the South line Of said Northwest Quarter of the Northwest Quarter a distance of 209 feeg thence South IX) del~.ees 33 minutes 47 seconds East and parallel to said West line to the said South lin.e thereof; !thence South 89 degrees 26 minutes 44 seconds West on said South line to the point of cor~nencement. Except Parcel No. 8, Anoka County Highway Right-Of-Way Plat No. 16. ~ Also includiO, g that part of the Southeast Quarter of the Northwest Quarter of said Northwest Quarter lying northeasterly of Anoka County Highway Right-of-Way Plat no. 8. ("Subject Property:") This permit is issu,e.,d pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this pe4'mit are as follows: 1. This permit ~hall expire one year from the commencement of operations and the Permit Holder shall be responsible for providing the City with at least 48 hours advance notice of the date of commencement of operations. 2. All grading ot)emtions shall be conducted in accordance with the grading plan dated December 15, 1995, p~pared by Passe Engineering, Inc. The proposed area to be graded is roughly eighty-five (8,5) acres in size. Excavation of the entire area shall be permitted. Continuation of grading shallirequire finished grade areas to be restored with six (6) inches of topsoil, seed and disc anchorex~ mulch. 3. All equipment .us. ed. for grading and hauling operations shall be maintained and operated in such a manner to mmmuze noise, dust, and vibrations adversely affecting surrounding properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed from the worksite regularly.
