CouncLlmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION NO. 96-04- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF <br />PERMIT BASEI} ON FINDINGS OF FACT # AND <br />PERMIT TO GRADE AND EXPORT SOILS <br /> <br />A CONDITIONAL USE <br />DECLARING TERMS OF <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. adopting Findings <br />of Fact # for ~s use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFQRE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On ) , 1996, a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to Good Vidue Homes, Inc. ("Permit Holder") for grading operations on the property legally <br />described as follow.~: <br /> <br />The North Half of the Northwest Quarter of Section 27, Township 32, Range 25, Anoka <br />County, Mi~_ nesota, EXCEPT the following described tract: <br /> <br />That part off the Northwest Quarter of the Northwest Quarter of said Section 27 described as <br />follows: COmmencing at the Southwest comer thereof; thence north 00 degrees 33 minutes 47 <br />seconds We~st on the West line of said Northwest Quarter of the Northwest Quarter for a <br />distance of 418 feet; thence North 89 degrees 26 minutes 44 seconds East and parallel with the <br />South line Of said Northwest Quarter of the Northwest Quarter a distance of 209 feeg thence <br />South IX) del~.ees 33 minutes 47 seconds East and parallel to said West line to the said South <br />lin.e thereof; !thence South 89 degrees 26 minutes 44 seconds West on said South line to the <br />point of cor~nencement. The <br /> conditions of this pe4'mit are as follows: <br /> <br />1. This permit ~hall expire one year from the commencement of operations and the Permit Holder <br /> shall be responsible for providing the City with at least 48 hours advance notice of the date of <br /> commencement of operations. <br /> <br />2. All grading ot)emtions shall be conducted in accordance with the grading plan dated December <br /> 15, 1995, p~pared by Passe Engineering, Inc. The proposed area to be graded is roughly <br /> eighty-five (8,5) acres in size. Excavation of the entire area shall be permitted. Continuation of <br /> grading shallirequire finished grade areas to be restored with six (6) inches of topsoil, seed and <br /> disc anchorex~ mulch. <br /> <br />3. All equipment .us. ed. for grading and hauling operations shall be maintained and operated in such <br /> a manner to mmmuze noise, dust, and vibrations adversely affecting surrounding properties. <br /> All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed <br /> from the worksite regularly. <br /> <br /> <br />
