Councilmcmbce Beyer introduced the following i'csolution and moved for its adoption: RESOLUTION 91-04-087 RESOLUTIO~q DECLARING CONDITIONS OF CONDITIONAL USE PERMIT FOR AN ALUMINUM PROCESSING PLANT WHER~ AS, the Ramscy City Council adopted Resolution ~91-04-086, regarding Finding~ of'Fact for this t~se and herein approves a Conditional Use Permit subject to the following conditions. NOW THERISFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY[~ ANOKA COUNTY, STATE OF MINNESOTA, as follows: On April 23, 19~91, a cond/taonal use perm t ( CUP ) was issued by the C~ty of Ramsey ( C~ty ) to Aluminum Recycling Processing, Inc. ("Permit Holder") to operate an aluminum processing plant in the B/W Busing:ss Warehouse District on approximately 2.58 acres of land legally described as follows: Lot 2, Block 1, Gateway North Industrial Park Plat 1. Subsequent to that, the Permit Holder assigned its interest to Alloy Recovery Company. This ~ermit is' issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are as fo~ows: 1. Term. ?his permit shall remain in effect so long as the conditions imposed herein are complied with. 2. Noise. Noises emanating from the site and operations shall be in compliance with and regulate~ by the State of Minnesota Pollution Control Standards, Min_nesota Rules 7010.0010 to 7010.0080, as amended except as modified herein by City performance requirements. 3. Dust/As.h/Particulates. The emission of dust, ash or other particulates matter shall be in compliatace with and regulated by the State of Minnesota Pollution Control Standards, Mirmeso, ra Rules 7005.0010 - 7005.0080, 7005.2770 subp. 2.A., and 40 CFR Pan 50 as amended except as modified herein by City performance requirements. Odor. TI3e emission of odor from the operation shall be in compliance with and regulated by the State!of Minnesota Pollutioh Control Standards, Minnesota Rules 7005.0920, as amended except ~ modified herein by City lxa'formance requirements. Smoke. Thc emission of smoke from thc operation shall be in compliance with and regulated by the Sere of Minnesota Pollution Control standards, Minnesota Regulation 7005.0480 subp. 1.B., as amended except as modified herein by City performance requirements. Furnace EmissSon~ ancl Mgnitgring. Emissions from the melt furnace shall comply with State and Fedekal regulations as they exist and may be modified from time to time dm-lng the per/od of this ,C~. An independent'testing laborato~ shall conduct emissions monitoring.at least once perI year and on a more frequent basis if pollutants are in excess of standards. The Permit Holder shall make a complete report avhilable to the City within thirty (30) days of complefibn by the testing laboratory. At a mirtimum~ the parameters of such emissions monitoring shall include the following State and Federal criteria.pollutant emissions as may exist frown time to 'time during the term of this permit. The cost of such testing and reports shall be borne by the Permit Holder.
