Councilmcmbce Beyer introduced the following i'csolution and moved for its adoption: <br /> <br />RESOLUTION 91-04-087 <br /> <br />RESOLUTIO~q DECLARING CONDITIONS OF CONDITIONAL USE PERMIT <br />FOR AN ALUMINUM PROCESSING PLANT <br /> WHER~ AS, the Ramscy City Council adopted Resolution ~91-04-086, regarding Finding~ <br />of'Fact for this t~se and herein approves a Conditional Use Permit subject to the following conditions. <br /> <br />NOW THERISFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY[~ ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> On April 23, 19~91, a cond/taonal use perm t ( CUP ) was issued by the C~ty of Ramsey ( C~ty ) to <br /> Aluminum Recycling Processing, Inc. ("Permit Holder") to operate an aluminum processing plant in <br /> the B/W Busing:ss Warehouse District on approximately 2.58 acres of land legally described as <br /> follows: <br /> Lot 2, Block 1, Gateway North Industrial Park Plat 1. <br /> <br /> Subsequent to that, the Permit Holder assigned its interest to Alloy Recovery Company. <br />This ~ermit is' issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this <br />permit are as fo~ows: <br /> <br />1. Term. ?his permit shall remain in effect so long as the conditions imposed herein are <br /> complied with. <br /> <br />2. Noise. Noises emanating from the site and operations shall be in compliance with and <br /> regulate~ by the State of Minnesota Pollution Control Standards, Min_nesota Rules 7010.0010 <br /> to 7010.0080, as amended except as modified herein by City performance requirements. <br /> <br />3. Dust/As.h/Particulates. The emission of dust, ash or other particulates matter shall be in <br /> compliatace with and regulated by the State of Minnesota Pollution Control Standards, <br /> Mirmeso, ra Rules 7005.0010 - 7005.0080, 7005.2770 subp. 2.A., and 40 CFR Pan 50 as <br /> amended except as modified herein by City performance requirements. <br /> <br />Odor. TI3e emission of odor from the operation shall be in compliance with and regulated by <br />the State!of Minnesota Pollutioh Control Standards, Minnesota Rules 7005.0920, as amended <br />except ~ modified herein by City lxa'formance requirements. <br /> <br />Smoke. Thc emission of smoke from thc operation shall be in compliance with and regulated <br />by the Sere of Minnesota Pollution Control standards, Minnesota Regulation 7005.0480 <br />subp. 1.B., as amended except as modified herein by City performance requirements. <br /> <br />Furnace EmissSon~ ancl Mgnitgring. Emissions from the melt furnace shall comply with State <br />and Fedekal regulations as they exist and may be modified from time to time dm-lng the per/od <br />of this ,C~. An independent'testing laborato~ shall conduct emissions monitoring.at least <br />once perI year and on a more frequent basis if pollutants are in excess of standards. The <br />Permit Holder shall make a complete report avhilable to the City within thirty (30) days of <br />complefibn by the testing laboratory. At a mirtimum~ the parameters of such emissions <br />monitoring shall include the following State and Federal criteria.pollutant emissions as may <br />exist frown time to 'time during the term of this permit. The cost of such testing and reports <br />shall be borne by the Permit Holder. <br /> <br /> <br />
