PUBLIC HEARING
PLANNING COMMISSION
CITY OF RAMSEY
ANOKA COUNTY
STATE OF MINNESOTA

The Ramsey Plarming Commission re. convened a public hearing on Tuesday, April 4, 1995 at the
Ramsey Municipgl Center, 15153 Nowthen Boulevard N.W., Ramsey, Minnesota to hear further
input regarding a ~request for a conditional use permit (CUP) for a group foster care home; case of
Patrick McLafferty.

Members Present:'.

Chairperson David Bawden
Commissioner Benjamin Deemer
Commissioner Terry Hendriksen
Commissioner Paul Holland
Commissioner Charles LaDue
Commissioner Michael Terry
Commissioner Bradley Thomd

Also Present:

City Engineer Steven Jankowski
Zoning Administrator Sylvia Frolik
Attorney Gerry Randall

CALL TO ORDER

Chairperson Bawden reconvened the public hearing at 7:35 p.m.

PRESENTATION

Zoning Administrator Frolik reported that, prior to the Planning Commission's March meeting,
City Staff had mgt with City Attorney Goodrich concerning this subject and its relationship to
MS462.357, Subdivisions 7 and 8. It was Mr. Goodrich's opinion that a State-licensed residential
facility serving from 7 to 16 persons is not exempted from the local R-1 Residential zoning
regulations; such ~t facility is more appropriately located in a multi-family use district. It was also
his opinion that t~permit locating a multi-family use or facility serving 7 to 16 persons in an R-1
zoning district in [ffect rezones that property to multi-family, and thus becomes a matter of spot
zoning which as !~nappropnate. Therefore, at was Mr. Goodrich s adwce and Caty Sta.ff, s
recommendation ~at the present application be rejected because it is a multi-family use in the City s
R-1 zone and it d,6es not have a state law exemption per either Subdivision 7 or 8 of MS462.357.
However, when t~e March Planning Commission meeting was called to order, Mr. McLafferty
insisted that the p~blic hearing be opened despite City Attorney Goodrich's advice to reject the
application. Hence, the Planning Commission proceeded to conduct the public hearing which was
recessed until ton!ght, in order to obtain further input from those who were informed that the
public hearing wa.q not going to be held because of Mr. Goodrich's advice to reject the application.

CITIZEN INPUT
Cai Henderson, 7310 155th Avenue N.W. - stated that this was being dealt with on the wrong
level. He felt thi~ is a matter of crime and the public's right to know and right to safety. Mr.
Henderson comm[nted that Mr. McLafferty stated he was licensed by the Volunteers of America
but neglected to s~ty he is also licensed by the Department of Corrections. Although he has no
choice about Mc~Lafferty being licensed for six boys, Mr. Henderson vehemently opposed
increasing that limit to eight. Mr. Henderson noted that McLafferty stated both the City of Ramsey
and Anoka County were informed of the home, yet as of 3/31/95 the Director of Corrections of

Public Hearing/Planning Commission/April 4, 1995
Page 1 of 4
