Councilmember introduced the following resolution and moved for its adoption:. <br /> <br />PROPOSED RESOLUTION g96-05- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT FOR A FOSTER GROUP HOME AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Patrick J. McLafferty has properly applied for a conditional use permit for a <br />foster group home in the singe family dwelling unit on the property generally known as 7321 <br />154th Lane N.W. and legally described as follows: <br /> <br />The South 240 feet of the North 480 feet of the West 225 feet of the East 850 feet of the <br />Southeast Quarter of the Northeast Quarter of Section 21, Township 32, Range 25 in <br />Anoka County, Minnesota; said distances being measured parallel with the East and North <br />lines of said Southeast Quarter of the Northeast Quarter; subject to an easement for road <br />purposes over the South 33 feet thereof. Anoka County, Minnesota (Subject Property); and <br /> <br /> WHEREAS, the Planning and Zoning Commission met on May 7, 1996, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # .. , a conditional use permit for a group foster home is <br />hereby granted to Patrick J. McLafferty, hereinafter referred to as "Permittee". <br /> <br />Should the Permittee die or move to a new location, the permit shall be automatically <br />terminated; except that in the case of death, should a surviving spouse residing at the same <br />address desire to continue the foster home, written notice to that effect shall be given to the <br />City Administrator, and the City Council may authorize continuation of the permit without <br />further hearing. <br /> <br />3. The facility shall serve no more than eight (8) foster children. <br /> <br />The Permittee shall maintain current State and County licenses at all times; any lapse of <br />required licensing shall be automatically terminate this Permit. <br /> <br />The Permittee shall be responsible for maintaining the dwelling unit in compliance with all <br />applicable Fire and Building Codes. <br /> <br />o <br /> <br />The Permittee shall not make alterations to the exterior of the house or property that are not <br />residential in character. <br /> <br />4 <br /> <br />Extraordinary incidences of police and/or zoning complaints shall serve as just cause for the <br />City Council to consider revocation of this Permit in accordance with procedures <br />established in Section 9.03.04 (Conditional Use Permits) of the City Code. <br /> <br />That ail costs incurred by the City in administering and enforcing this permit shall be the <br />responsibility of the Permittee. <br /> <br />That the City Administrator or his/her designee shall have the right to inspect the Subject <br />Property for compliance with the provisions of this Permit annually or at any time upon <br />reasonable request. <br /> <br />10. <br /> <br />I1. <br /> <br /> <br />
