CASE # 7

REQUEST FOR A CONDITIONAL USE PERMIT FOR AN
OFF-SITE ADVERTISING SIGN;
CASE OF HOLM'S SUPER BOWL, INC.
By: Zoning Administrator Sylvia Frolik

Background:

Tim Holm of Holm's Super Bowl, Inc. is the new owner of the Super Bowl facility. Since
taking ownership of the business, he has learned from City Staff that each commercial
parcel is allowed one free-standing sign not to exceed 100 square feet in size and Code also
restricts signs to identifying the business or service offered at the parcel on which the sign
is located. Mr. Holm has stated he feels he is in a unique situation being located one block
off the highway and the lack of identification of the bowling alley on Highway #10 has an
adverse impact on his business. Therefore, he has submitted and application for a
conditional use permit for an off-site advertising sign that would be placed on the Dubats
property at 6740 Hwy. #10.

The following items are enclosed for your information:

a)
b)
c)
d)

Site location map
Proposed sign
Proposed findings of fact
Proposed conditional use permit

Notification:

In accordance with State law, properties within 350 feet of the subject property were
notified of the public hearing pertaining to the request.

Observations:

The previous owner of Super Bowl had a lawful non-conforming ('grandfathered')
identifcation sign on the Dubats property and for various reasons, removed it knowing full
well that under the new regulations it could not be replaced without obtaining a conditional
use permit from the City.

Since removal of the sign, Mr. Holm purchased the Super Bowl facility and he feels lack of
identifcation on the highway has hurt the business. He would like a conditional use permit
to replace the sign in its previous location on the Dubats property.

The Dubats proPerty already has an 84 square foot sign on Hwy #10 and a 24 square foot
lawful non-conforming sign on Riverdale Drive N.W. Approval of Mr. Holm's request
would result in 3 free-standing signs on the parcel totaling 180 square feet of sign space.
There are numerous businesses that would like to be identified on Hwy. #10 and approval
of Mr. Hohn's request would set a precedent.
