CASE MINING AND GRADING PERMIT FOR LOT I BLOCK 5 RUM ACRE ESTATES By: Steve Jankowski, City Engineer Background: Rum Acm Hstates was platted in 1974, however, Lot 1 Block 5 of the subdivision was encumbered ~with a temporary drainage easement until an outlet for thc dminagc no longa' required thaVthe lot itself be utilized as a reservoir for the drainage of the surrounding area. An outlet foi this lot was constructed in 1990 as a part of the utility work for the Juniper Woods Dev{lopment. The lot owner has taken steps to remove the temporary drainage easement on "the property. In anticipation of this easement vacation, the owner of the lot caused the placement of approximatel~ four feet ofimporaxl fill material during the spring and summer of 1996, to establish a house pad. The volume of this fill and the fact that it was imported required that a mining and!gm__ding conditional use permit should have been obtained. A certificate of survey has been prepared identifying existing elevations and proposed future grading associated with the structure. Recommendation: Staff recommends the following conditions should be included in the mining and grading 1. ThI~ applicant shall pay the .cost associated with the patching of the pavement of Juniper Ridg~ Drive, where the pavement was broken up by the tractor hauling material to the site. This~cost shall be agreed to be $250.00. 2. The applicant agrees to grade the lot in accordance with the Certificate of Survey, prep .~k*ed by Charles F. Anderson and dated November 19, 1996. 3. The applicant agrees to establish turf over all dis-tm'bed area by seeding or sod before June 1' 1997. Commission Action: Based upon discussion.
