Councilmember ~ introduced the following resolution and moved for its adoption: <br /> RESOLUTION NO. 97-01- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE oF A CONDITIONAL USE <br />PERMIT BASE~) ON FINDINGS OF FACT # AND DECLARING TERMS OF <br />PERMIT FOR GRADING AND FILLING <br /> <br /> WHEREA~., ~e Ramsey City Council adopted Resolution No. 97-01-_._ adopting Findings <br />of Fact # for grading and filling and herein approves thc Conditional Usc Permit subjcc~ to the <br />following conditio/~s. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE crrY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> On , ~ ,1997, a Conditional Usc Permit ("CUP") was issued by thc City of Ramscy <br /> ("City") to John Pcterson CPermittee") for filling operations on thc property located in the Southwest <br /> Quarter of thc Southwest Quarter of Sccfion 3, Township 32, Rangc 25, Anoka County, Minnesota, to <br /> provide benefit to ~!e Northeast Quarter of the Northeast Quarter of Section 9, Township 32, Range <br /> 25, Anoka County, !Minnesota. ' .' . <br /> <br /> ("Subject Property") - <br /> This permit is issu~ed pursuant to Section 9[03.04 and 9.1.18 of thc Ramsey City Code. Thc <br /> conditions 'of thi.~ .txmafit are as follows: <br /> <br /> Thc P _em~itt~ shall re-establish natm'al drainage by replacing the existing 12 inch culvert, with <br /> .a 15 inch smooth interior culvert. The culvert shall include a flared end section on thc upstream <br /> side to e.nha~ .ce flow characteristics.' The culvert shall be set no greater than 0.1 feet higher <br /> than thc 'mvc~-t of thc downsl~_ m corrugated metal pipe culvert. The culvert material may be <br /> polyethylene, but it shall conform to class I reinforced concrete pipe strength specification. <br /> T/ac culvert ~ be installed within 45 days of thc issuance of the Permit so that it will be <br /> functional toShandle precipitation/melt events which occur in the Spring of 1997. <br /> <br /> The Permitt~ shall smMlizc the back slopes of the fill over those sections of the roadway <br /> which have [~cen elevated more than 12 inches from the filling. This shall be done by placing <br /> -straw over thc roadway and backslopes and seeding thc backslopc and'outermost five feet of <br /> thc roadway ~rith oats or annual rye. This work should be completed prior to April 15, 1997. <br /> <br />'3, Thc Pcrmitt--~-' shall regrade all borrow areas such that the slope is no greater than three <br /> " horizontal to ~>ne vertical. Thc slopes should be seeded with oats or annual rye and mulched <br /> with straw..This work should bc c0mplcted by Junc 15, 1997. <br /> :' "All costs incurred by thc City in executing and arlm~nistering this permit shall be abe <br /> responsibili~ of the Permittee. The Peamlttee shall maintain a minimum balance of Three <br /> Hundred Dollars and no/cents ($300.00) in an escrow account with the City. This escrow <br /> shall be used!!Itnto reimburse the City for eXpenses incurred in the administration of the Permit. <br /> At the time ~ conditions specified in this Permit have been met, the balance of the escrow shall <br /> be returned tO the Permittee. <br /> <br />5'. <br /> <br />In the event mY of the Permit conditions are not met within the specified time frame, the City <br />shall cause tht;' necessary work to be performed and shall bill the Permittee for the cost of the <br />work plus a tSn pement (10%) administrative charge. If not paid, the Permittee agrees to have <br />this charge certified as a special assessment to the benefitted property. <br /> <br /> <br />
