7 CASE # 5 REQUESTITO REZONE CERTAIN PROPERTY FROM B-2 BUSINESS AND RURAL RESIDENTIAL TO R-3 URBAN RESIDENTIAL; CASE OF ~kNOKA HENNEPIN INDEPENDENT SCHOOL DISTRICT NO. 11 By: Zoning Administrator Sylvia Frolik Background: R.1 School DistriCt No. 11 is in the process of planning an expansion to thc Ramsey Elementary School facility. The School District has acquired two parcels south of the existing school site to accommodate He expansion. The existing s~hool site is zoned R-1 Rural Residential and the two acquired parcels to the south are zoned B-2 Business, for which schools are not a permitted use. This results in the school being conside] ed lawful non-conforming and to expand a lawful non-conforming use requires a conditional use ~ermit or a rezoning. The School District is requesting that the property be rezoned to R-3 Urban lJ :sidenfial, for which schools are a permitted use. Observations The site is approximately 52 acres in size. The school site is bounded on all sides by single family residential. HoWever, there is additional R-3 Urban Residential zoning south of the school. The Planning Cpmmission conducted a public hearing on January 3 and there were no verbal or written commen~s submitted. The following items are enclosed for your information: a) Site location map b) 1~ posed findings of fact c) P/'oposed ordinance RecommendatiOn: The Planning Commission and City Staff recommend approval of the proposed rezoning. Council Action: Motion to: Adopt Resplution #95-01 adopting Findings of Fa~t ~. relating to a request from Anoka He~iPaepin Indpendent School District No. 11 to rezone certain property from B-2 Business a~d R-1 Rural Residential to R-3 Urban Residential.
