I I I I I I I I I I I I I I I I I I ORDINANCE #90-15 CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AN ORDINANCE AMENDING CHAPTER 130 OF THE CITY OF R~AMSEY BY ADDING CHAPTER 130.12 LICENSES FOR PAWNBROKERS CITY CODE OF THE WHICH REQUIRES The City Council of the City of Ramsey Ordains: SECTION 1.~ AMENDMENT Chapter 130 of the Code of the City of Rarnsey is added to read: SECTION 130.121. DEFINITIONS When used in thins section, the following words shall mean: City The City of Ramsey, Anoka County, Minnesota. Licen~e~l Premlse_s,; The specific building which has been licensed pursuant to this chapter. "Licensed Prerntses does not include any out buildings, attached or detached to the licensed premises. pawnbroker. ~ A person who loans money on deposit of or pledge for personal property or other valuable th!ng, or who deals in the purchasing of personal property or other valuable things on condition of ~lling the same back again at a stipulated price, or who loans money secured by chattel mortgag~ on personal property, taking possession of the property or any pan thereof so mortgaged. Receive. To purchase, accept for sale on consignment or take in pawn any secondhand good. Secondhand (]oods Dealer. Any person, partnership, fin-tn or corporation whose regular business include~ selling or receiving any tangible personal properties, excluding motor vehicles, previously used, tented or leased. The term secondhand goods dealer shall include pawnbrokers. Exemptions. SeCondhand Goods Dealer shall not apply to or include the following: 1. The sale of secondhand goods where all of the following are present. (a) The sale is held on property occupied as a dwelling by the seller or owned, ~ rented or leased by a charitable or political organization; (b) The items offered for sale are owned by the occupant; (c) That no sale exceeds a period of ninety-six (96) consecutive hours; (dr) That no more than four (4) sales are held in any twelve month period; (e) That none of the items offered for sale shall have been purchased for resale or received on consignment for purpose of resale. 2. TI'ie sale of secondhand books or magazines. .. 3. The sale of goods at an auction held by an auctioneer. 4. The business of buying or selling only those secondhand goods taken as pan or full pa~yment for new goods and where such business is incident to and not the primary bu~siness of a person. Zq'7
