He advised that the topography map <br /> shows much of Mr. Leonard's yard to be at the same delineation of the adjacent wetland <br /> accfiunting for the sponginess, however, he added that the wetland cannot be drained to make it <br /> low~r than the elevation of Mr. Leonard's yard. <br /> <br /> Mri~Leonard also commented on the size of the backyards in this subdivision, noting that they may <br /> be ~ble to sell them the first time, but as he is in real estate, he would find it difficult for resale. <br /> Co~ssioner Deemer noted his concern about the ponding area near Lots 7, 8, 11, and 12. <br /> <br /> Mr. Jankowski proceeded to outline the drainage system. <br /> <br /> M~. Leonard inquired whether the area residents are just stuck with the fact that the Ordinary High <br /> W~ater mark is in error. <br /> <br /> COmmissioner Deemer stated that unless its proven otherwise, they are stuck with it. <br /> <br /> Mr:. Leonard reiterated that he didn't feel there had been excess rainfall this last summer and yet the <br /> w~ater level has been high; it simply is not working. <br /> <br /> Mr. Jankowski suggested that there might be some sediment in the storm sewer that's affecting it, <br /> s~ the City will have it cleaned. <br /> ~. Leonard cautioned proceeding with this plat, stating that an additional 34 more homes to this <br /> area is not going to improve the situation. <br /> <br /> Blaine Edmundson, 4937 142nd Lane N.W. - stated that he owned 20 acres on the comer of 153rd <br /> Avenue N.W. and Highway #47, and he expressed concern that the drainage would affect his <br /> property. <br /> <br /> ~ADJOURNMENT <br /> <br />~Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to adjourn the <br />~public hearing. <br /> <br />~Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />~Terry, and Thomd. Voting No: None.
