NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY,iANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Applicant appeared before the Planning Commission for a public hearing pursuant to SectioB 9.03.04 of the Ramsey City Code on February 7, 1995, and that the public hearing Was properly advertised and that the minutes of said public hearing are hereby incorporate' ed by reference. 2) That the Subject site is approximately 30 acres in size. 3) That a commercial asphalt bituminous plant is not a permitted use in any district in the City of Ramsdy. 4) 5) 6) 7) 8) That the City of Ramsey issued a conditional use permit to the Applicant for an asphalt productic~n plant on January 12, 1988. That the p~reviously issued conditional use permit expired on January 31, 1995. That on J~anuary 20, 1995, the Applicant applied to the City for a new conditional use permit to ~:ontinue the production of asphalt on the subject property. That the i~djacent properties to the north, south, east and west are zoned either Business WarehouSe or Industrial. That the general vicinity of the proposed faciity was zoned Industrial until 1990. The proposediuse is compatible with the surrounding industrial uses that developed in the area prior to t~e rezoning to Business Warehouse in 1990. 9) 10) 11) 13) That the City has previously issued other conditional use permits for heavy industrial uses in the BuSiness Warehouse District. That the ~asphalt production plant will continue to require silos and conveyers totaling approximhtely 65 feet in height. That the Applicant has stated that the plant will continue to process demolition concrete and asphalt in~o aggregate for re-use. That the iuse is proposed to continue in operation from approximately April through November of each year and mn approximately 14 hours per day, Monday through Saturday. That the Applicant has been issued a General Air Emission per'nit for a hot mix asphalt facility #]3941-93-G-1 which was issued on April 4, 1993 and expires on January 25, 1998. iq-7
