I I I I If the violations are not corrected within the given 30 days, a public hearing conducted by the City Council shall be scheduled for the first regular Council meeting occurring 30 days after the notice of possible violations of the accessory apartment permit. At the public hearing for the purpose of revoking the accessory apartment permit, the City Council shall consider the evidence and with a majority vote take one of the following actions: (a) Revocation of the accessory apartment permit. (1) By resolution, adopt Findings of Fact that support revocation of the accessory aparunent permit. (2) By motion, revoke the accessory apartment permit based on the Findings of Fact. (b) Continuation of accessory apartment permit. (1) By resolution, adopt Findings of Fact that support contin- uation of the accessory apartment permit. (2) By resolution, confirm the continuation of the accessory apartment permit and reaffirm the conditions of the permit. Tl~e, accessory apartment permit, and any extension of said permit, shall terminate up~}n the death of the permit holder, or the joint tenant survivor of the permit holder;, upon the transfer of title to said premises~ or upon the permit holder or the joint tefiant survivor of the permit holder no longer occupying' the premises as their prit~eipal residence. UgOn .the sale of a home having an accessory apartment permit, the buyer must regew the permit but will not be subject to the two-year occupancy requirement. Th~ procedure for permit renewal by the home buyer shall require submittal of an acc~essory apartment application form and fees and affidavit of residency and ov~nership. If there have been no changes made or changes proposed to be made to th{ site plan and floor plan that was originally considered in permit issuance, then City Council may approve renewal and transfer of the permit without a public he,ring and recommendation from the Planning Commission. 8.71.05 r Criteria bo The total occupancy level of the accessory unit created and the remaining portion of [ · * the~ong~nal single family structure shall be in accordance with the State Building Co.de or 300 square feet per person. No,exterior changes shall be made to the house, including additions or added entt_ances, which in the judgment of the City do not conform to the single family character of the neighborhood. The accessory apartment shall be designed so that, to t~e degree reasonably feasible, the appearance of the building remains that of a one, family residence. Construction or conversion of a garage loft or an accessory structure to an accessory apartment is prohibited.
