I

I
I
I
I
I
I
I
I
i
I
I
I
I

1)

Request!for a Conditional Use Permit for a Foster Care Group Home; Case of Patrick
mcLaffei~

Chairperson BaWden called the regular Planning Commission meeting back to order at 8:06 p.m.

COMMISSION BUSINESS

Case gl:

Rt~quest for Sketch Plan Review of Fox Knoll; Case of Rick Murray,
R'sidentiai, e Development Company, and Mark Kieckner, Fox
Di~velopment Co.

City Engineer Ja!akowski advised that Rick Murray of Residential Development Company and
Mark Kleckner o~Fox Development Company are requesting approval of a revised sketch plan for
Fox Knoll. Mr. J~mkowski explained that Mr. Kleckner had applied for a subdivision last year to
plat the 20 acres into two 10-acre rural lots, however, City Staff convinced him to postpone his
plat until this ye~ due to the anticipated expansion of the Metropolitan Urban Service Area
(MUSA) and the ~vailability of sewer and water to the site by mid 1995, which would allow the
property to be degeloped at urban densities. The subject property is now in the MUSA and is
zoned R-1 Urban IResidential. Mr. Jankowski stated there will be approximately 18-20 single
family units. He n~)ted that 151st Lane N.W. will be extended, resulting in exceeding the 600 foot
maximum dead entt street length, and that another cul-de-sac will be extended off 151st to access
the remainder of the developable property. He explained that the over-extended length of 151 st is
the only reasonab!e means of developing this property short of bridging wetlands (which is
unacceptable to DI~R) to construct through streets. Mr. Jankowski advised it is anticipated that
sewer and water will be provided to the property by extending the sewer trunk along the wetland
somewhat in conjunction with the service to the school, and the water will be extending also in
conjunction with the extension to the school without going through the Haubrich Addition. The
anticipated drainage will be predominantly from east to west, and will require some type of
ponding, possibly ha the park area, prior to discharge in the wetland. There are also plans to
extend the trail throtigh the subdivision over to the school property.

Rick Murray, Residential Development Company, stated that this is a beautiful site, adding that he
had initial concerns on incorporating a road system with the least amount of impact on the wetland
and trees. He presented Concept Plan gl, outlining the wetland, trees, proposed roads, and
building sites.

Commissioner Deemer inquired as to the status of the tree ordinance.

Mr. Jankowski stated that the ordinance is still in the drafting stage and cannot be enforced,
however the City has ~been getting cooperation from the developers.

Commissioner Deemer informed the applicant that this was not an official tool for the City.

IVh'. Murray stated he ihas been made aware of that, however, he will do what he can to cooperate
since he stands to benefit as well. Mr. Murray noted that he did have concerns with the trail
extension due to the fact that he does not own all the property involved.

Motion by CommissiC~ner Deemer and seconded by Commissioner Holland to grant sketch plan
approval to Fox Knoll and recommend that the developer proceed to apply for preliminary plat
approval.

Motion carried. V?ting Yes: Chairperson Bawden, Commissioners Deemer, Holland,
Hendriksen, LaDue, and Terry. Voting No: None. Absent: Commissioner Thorud.

Planning Commission/March 7, 1995
