F~er Discussion: Commissioner Deemer specifically requested an exhibit detailing where the <br /> dis~cts are located. Commissioner Hendriksen felt that these laws are becoming more and more <br /> elusive and that more and more is being taken from property owners. Mr. Jankowski indicated <br /> tha~ the proposed increase in height restriction is to allow for the construction of the more upscale <br /> tw~ and three story homes. The intent of the impervious surface area restriction was also <br /> discussed. Mr. Jankowski agreed that the purpose of the District is an admirable one but it has to <br /> m~e sense, and these changes were an attempt to do so. Commissioner Hendriksen expressed a <br /> ne:.~ to balance what the affect is and at what cost, explaining that there is becoming significantly <br /> greater impact on land owners and their property fights are being taken away in an arbitrary way. <br /> C~missioner Deemer also expressed concern that there were no references (for the lay person) as <br /> to ~hich overlay district applies to which fiver. <br /> <br /> ? <br /> M_~otion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br /> H~ndriksen, LaDue, and Terry. Voting No: None. Absent: Commissioner Thorud. <br /> ~se #6: Monthly Status Report <br /> <br /> ~mmissioner Deemer noted that Rebecca Jackson's request for a CUP for an accessory apartment <br /> i~ pending (since 7/5/94) on the ordinance which is being forwarded to City Council with a <br /> n~gative recommendation. <br /> ~hairperson Bawden inquired about whether Staff has researched the Amber Ridge drainage <br /> ~ystem (pending since 2/7/95). <br /> <br /> ity Engineer Jankowski replied that it has been found to be functioning, however when the water <br /> vel is only slightly higher than the Ordinary High Water, the flow out of the overflow is quite <br /> ~w and it takes a long time to drain down the last couple of inches. Mr. Jankowski suggests the <br /> 6vefflow be modified with either an arch pipe or a weir. <br /> <br /> ~hairperson Bawden asked if this addresses the concern of the resident at the public hearing. <br /> <br /> ~. Jankowski stated that the development of Amber Ridge provided for ponding which improved <br /> ithis resident's problem, however, since that time the ground water has risen. <br /> <br /> ~ommissioner Hendriksen referenced the pending direction from 2/7/95 regarding Northfork <br /> ?Moors plat's omission of a portion of the trail corridor, and he stated that Dennis Peck has advised <br /> him that this stub of trail corridor has been added to the plat. <br /> <br />~Case g7: Zoning Bulletin and Zoning News <br />? Commission Hendriksen referred to Planning Commission meeting minutes dated February 7, <br /> 1995, page M16 of the agenda, paragraph 5, and stated that he did not recall Chairperson Bawden <br /> and Commissioner Deemer agreeing with Commissioner LaDue's assessment that he was out of <br /> order.
