Trail a~d Sidewak Construction. CITY shall construct and pave in accordance <br /> with CITY standards, a ten (10) foot wide bituminous trail not to exceed 5% in grade, <br /> parallel to T.H. g47 along the entirety of Lot 1 and extending north to connect with the trail <br /> in Ambe~Ridge. There shall be a minimum of ten (10) feet between the edge of the trail <br /> pavementiand the adjacent property lines. The screening bexm shall be a minimum of seven <br /> (7) feet a~}ove trail surface and shall be forested. The DEVELOPER shall provide <br /> approved~turf establishment in conjunction with trail consa'uction within the subject plat. <br /> The CItY herein agrees that the DEVELOPER shall not be assessed for trail <br /> construcOon outside the Plat boundaries. The CITY shall also be responsible for <br /> constructt[ng a sidewalk parallel to Xkimo Street N.W. to connect with the sidewalk in <br /> River's B~nd 3rd Addition. <br /> <br />6. Imorovernents to be Constructed by Develooer. The DEVELOPER shall be <br /> responsibie, at its expense, for rough grading of all lots and streets in accordance with the <br /> grading plan consisting of one (1) sheet drawn by Peter Raatikka, P.E., dated January 30, <br /> 1993. Th.~ grading plan shall indicate lowest walkout floor elevations and sediment control <br /> during construction. The DEVELOPER shall also be responsible, at its expense, for <br /> installatiop of gas, telephone, and electric utility improvements, with the exception of street <br /> lights. Thee DEVELOPER shall be responsible for completing the rough grading and <br /> providing~lot comer stakes prior to the installation of underground utilities. <br /> <br />4 <br /> <br />Bouleva/rd and Area Restoration. The DEVELOPER shall be responsible for the <br />cost of establishing seed or sod in all boulevards within thirty (30) days of the completion <br />of the street improvements, and restore all other areas disturbed by the development <br />grading oPeration in accordance with the approved erosion and sediment control plan. The <br />DEVEL~IPER shall also be responsible for the cost of cleaning any soil, earth or debris <br />from the Wetlands within and adjacent to this Plat resulting from grading performed in the <br />development of the land. <br /> <br />Financini,. In the event that the CITY, for whatever reason, is unable to sell the bonds <br /> r-- <br />as anticip!ted herein, the construction of the improvements shall immediately cease until the <br />CITY approves an altema{e method by which to insure payment to the contractor for <br />construction of the Stage I Improvements. <br /> <br />Develop~ Reimbursement of All City Exoenses. The DEVELOPER agrees to <br />fully reimburse the CITY for all costs incurred by the CITY including, but not limited to, <br /> <br /> <br />
