Sodded boulevards are a requirement for each lot in the <br />Plat pno~to issuance of a Certificate of Occupancy. In accordance with City Code and the <br />policy es~blished by the City of Ramsey Park and Recreation Commission on June 10, <br />1993, the!DEVELOPER is required to submit a Landscape Plan for CITY approval that <br />identifieslexisting tree growth within the Plat that will be preserved during construction <br />and new plantings. It is herein agreed that the requirement for a Landscape Plan shall be <br />fulfilled b~ the DEVELOPER as follows: <br /> <br />a) Minimizing the impact of construction on trees in accordance with Minnesota Extension <br /> Servi~e publication "Protecting Trees From Construction Damage" (Publication #NR- <br /> FO-6i35-S). <br /> <br />b) Planting one two-inch diameter tree (or equivalent thereof) of an approved species at the <br /> road frontage or in the front yard of each of the lots in the Plat prior to the issuance of <br /> a Cert~.'.'ficate of Occupancy. In the event the weather is not conducive to tree or sod <br /> planti~ g at the time of Certificate of Occupancy, the Building Permit holder shall place a <br /> cash 4eposit in the amount of $200.00 for trees and $100.00 for sod in an escrow <br /> accougt with the CITY and upon verification of the planting being accomplished, said <br /> cash d~eposit shall be refunded to the Building Permit holder. Failure of the Builder to <br /> comply with the planting requirement within a reasonable time frame following a <br /> dete ~nainafion by the CITY that weather conditions are conducive to planting shall give <br /> the CiTY authority to cause the planting, the cost of which shall be charged to the <br /> escrow account and the Builder shall not be eligible for a refund of the cash deposit <br /> made for this purpose. <br /> <br />22. Tree Di{e. ase Prevention and Disnosal. The DEVELOPER shall prevent the <br /> introduction and spread of tree disease into the residual tree populations of the Plat and <br /> adjoining properties and reduce the impacts of construction on the residual property of the <br /> Plat and [djoining properties. The DEVELOPER in order to accomplish in accordance <br /> with "Pro~cting Trees From Conslruction Damage" (attached hereto as Exhibit 'A'), shall: <br /> <br /> <br />
