RESOLUTION 4~95-04- <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN <br />PROPERTY ~ROM B-1 BUSINESS TO B-2 BUSIN~rg' <br /> <br /> WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.0~..03 of the Ramsey City Code; and <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY,~ ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That Polka Dot Dairy, Inc., and Rum River Properties, hereinafter referred to as <br /> "ApplJc~ts", have properly applied to rezone certain property from B-1 Business to B-2 <br /> Business~ <br /> <br />2. That the planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br /> the City ~.ode on April 4, 1995 and that said public hearing was properly advertised and <br /> that the niinutes of said pubIic hearing are hereby incorporated by reference. <br /> <br />That the 9roperty proposed to be rezoned is legally described as follows: <br />That par[~~ of the following described property lying southerly of "Line A" to be <br />hereinaft~ described: <br /> <br />That part of Government Lot 6, Section 36, Township 32, Range <br />2~., Anoka County, Minnesota, lying westerly of the centerline of <br />Srhte Trunk Highway No. 47 acc,o, rding to the duly recorded plats of <br />OiKBOW ADDITION, RIVER S BEND PLAZA and RIVER'S <br />B~ND PLAZA 3RD ADDITION; and lying north of the Northerly <br />li0e of the right-of-way of County Road No. 116 as now shown on <br />thg duly recorded plat of ANOKA COUNTY HIGHWAY RIGHT- <br />OF-WAY PLAT NO. 36. The West line of said Government Lot 6 <br />is! as now shown on the duly recorded plats of said OXBOW <br />ApDITION and of MINERAL POND, and is also on the westerly <br />e~tension of the monumented North line of the duly recorded plat of <br />BROM ADDITION, said corner and line also being marked by <br />Judicial Landmarks set pursuant to Torrens Case No. T-2299. <br /> <br />Said "Line A" being described as commencing at the Northwest corner of said <br />Government Lot 6; thence South 0 degrees 39 minutes 51 seconds East, assumed <br />basis of ~earings, along the above described West line of Government Lot 6 for a <br />distance ~>f 653.32 feet to the actual Point of Beginning of said "Line A" to be <br />hereby d~scribed; thence North 66 degrees 40 minutes 42 seconds East for a <br />distance ¢.f 451.63 feet, more or less, to intersect said centerline of State Trunk <br />Highway l'~o. 47 and there to terminate said "Line A". <br /> <br />Containir~ 2.57 acres, more or less, north of said North line of the right-of-way of <br />County R~oad No. 116. Subject to that part taken for said State Trunk Highway <br />No. 47 o~¢r and across the easterly 33.00 feet thereof as measured at right angles to <br />said centei'line.
