He suggested assessing all and refunding the residents who paid to have a <br />sro _~rrn sewer developed. <br /> <br />Mr~Goodrich stated that there was an ordinance:adopted in 1986 that excluded certain <br />properties from assessments for th~s type of project for five years (1991). <br /> <br />Mr. ZBerg stated that the City cannot show benefit to his property in River's Bend. <br /> <br />Mr. Goodrich explained that individual benefit does not have to be shown under Chapter <br />444:. <br /> <br />Charles Canesi, 7751 - 166th Avenue N.W., Ramsey, inquired how many homes are in <br />the drainage area. <br /> <br />Mr. Jankowski replied about 4,000. <br /> <br />Mr. Canesi inquired if the land that will be saved will eventually be developed. <br /> <br />Mr.}Jankowski replied that the area is currently rural but it possibly could be developed in <br />the future. <br /> <br />Mr~Canesi suggested levying a tax on the developer and leaving the citizens alone. He <br />commented that maybe the residents should have a Boston Tea Party; enough is enough. <br />He inquired if a permit was given for the pond. <br /> <br />Mr.~Jankowski stated he did not believe a permit had been issued for the pond. <br /> <br />Mr.~ Canesi suggested taking the pond out. <br /> <br />Mr.~Jankowski stated that this is a natural low area. The City has no reason to dictate what <br />the _owner could do with his land. <br /> <br />Mr. Canesi inquired if it was built in the line of the ancient ditch. <br /> <br />Mr. Jankowski replied yes. <br /> <br />Mr~ Canesi stated that the City is at fault. He stated that if the person put the pond in <br />without the City's knowledge, they should be fined. <br /> <br />Mr. Schroeder stated that there is a natural drainage way. The City of Ramsey does not <br />have a right to be on that property. We do not own an easement to ensure the drainage <br />goers anywhere. Part of this project is to gain a fight to a utility and drainage easement. <br /> <br />Mr(Canesi inquired who built the drainage way. <br /> <br />Mr)Jankowski replied County Ditch #3 was constructed by the County in 1890 - they have <br />legal fights to that land.
