Mr. Bacon stated he is not in favor of being assessed for the swamp way over there. He thanked Council for allowing his input and expressed concern about future utilization of ditch laws. Motion by COuncilmember Peterson and seconded by Councilmember Beyer to close the public hearing. Motion carrie4t~. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen and Zimmerman. Voting No: None. The public hearing adjourned at 8:17 p.m. Council Business Mayor Hardin called the regular portion of the City Council meeting back to order at 8:17 p.m. Terry Hendril~sen, 15631 Ramsey Boulevard N.W., Ramsey, stated he has a lot to do with why the other...res~dents are here. He reported that he has never been in favor of assessing this project. 'Bae original project was not to be assessed; it was only at an earlier meeting that it was suggested it be handled under Chapter 444. He noted that Clayton Berg was the building inspector at the time he constructed his buildings. The largest building was inspected by Mr. Berg and to the best of his (Hendriksen's) knowledge, the building is in conformance With City Code. He continued that when he built the loafing shed, he was red tagged becausle he needed a conditional use permit, which he got. He reported that he has followed everY rule of the City. Councilmemb,'er Peterson stated that a comment was made about assessing the project using property valu~ and inquired of Attorney Goodrich if it could be done on land area. City Attorney.Goodrich stated that we do not have the ability to do that. Mayor Hardin asked for clarification on subdistricts. Mr. Goodrich stated if it were assessed to subdistricts, we would have to amend the ordinance to create subdistricts as there are none right now. Motion by Cogncilmember Peterson and seconded by Councilmember Zimmerman to adopt Resolution g95-03-049 ordering the project and the preparation of plans and specifications for Improvement Project itt05- 12. Motion carded. Voting Yes: Councilmembers Peterson, Zimmerman and Beyer. Voting No: Mayor Hardin and Councilmember Beahen. Councilmeml~er Beyer expressed a need to look at other areas of the City with regard to drainage problems. Mayor Hardin agreed that the City does have drainage problems. Councilmember Zimmerman stated we have maintained public roads, bridges, etc., but we have not main. rained our drainage ditches. The project ditch was built in 1890 and basically no maintenance has been done on it. Hopefully this project will address some concerns. City Council/March 14, 1995 Page 10 of 15 lq
