<br />CITY OF RAMSEY
<br />ANOKA COUNTY, MINNESOTA
<br />
<br />AGREEMENT, made and entered into by and between the CITY OF
<br />
<br />RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and R.F.
<br />
<br /> DEVELOPMENT, LLC, whose address is 241 Main Street, Elk River, MN 55330, (the
<br /> "D EYELO PER" ).
<br />
<br /> WITNESSETH:
<br /> WHEREAS, ELIZABETH J. RAUDIO and ARTHUR K. RAUDIO, husband
<br />and wife, whose address is 1404 S. Broadway, Sauk Rapids, MN 56379, and RAMSEY
<br />CENTER LIMITED PARTNERSHIP, whose address is 420 5th Street North, Room 900,
<br />Minnoapolis, MN 55401, and R.F. DEVELOPMENT, LLC, whose address is 241 Main
<br />Street, Elk River, MN 55330, are the fee owners of the following described property situated in
<br />the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as
<br />follows:
<br /> Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, and 16, Block 1; RIVER'S BEND
<br /> 4TH ADDITION, Anoka County, Minnesota
<br />
<br /> i~ ("Subject Property"); and
<br /> WHEREAS, on April 11, 1995, pursuant to Resolution No. 95-04- , the CITY has
<br />approved the final plat of the Subject Property which plat is known as RIVER'S BEND 4TH
<br /> ?
<br />ADDITION (the "Plat"), which approval is contingent on certain requirements, including
<br />DEVELOPER and CITY entering into this Agreement; and
<br /> ~ WHEREAS, the DEVELOPER has submitted a petition requesting the extension of
<br />sewer~d water to the Subject Property; and
<br /> WHEREAS, a trunk usage charge is required by the CITY for usage of its Trunk Sewer
<br />and Water System, which charge is $1539 per residential unit created; and
<br />
<br /> i. WHEREAS, the DEVELOPER has submitted a petition to the CITY requesting the
<br />construction of the folloWing improvements in the Plat, to-wit: Sanitary sewer, storm drainage
<br />facilities, watermains and appurtenances, and streets with concrete curb and gutter, which
<br />improvements are termed Stage I Improvements in the City Code ("Stage I Improvements"); and
<br /> WHEREAS, pursuant to said petition, the CITY ordered the preparation of a feasibility
<br />report-prepared by its City Engineer relating to the proposed Stage I Improvements; and
<br /> ~ WHEREAS, the CITY will conduct an Improvement Public Hearing on the Stage I
<br />Improvements prior to ordering the Improvements; and
