Future Connection of Xkimo Street to T.H. ~47. The DEVELOPER recognizes <br />the future need for the connection of Xldmo Street to T.H. ~47 and improvements to the <br />C.S.A.H. #$ and T.H. ~47 intersection and therefore agrees to enter into an agreement <br />with the CITY wherein Ouflots C and E, River's Bend 3rd Addition will be responsible <br />for fifty percent (50%) of the City's share of the cost of those improvements. The <br />DEVELOPER agrees to enter into such an agreement with the CITY prior to recording <br />the Plat. <br /> <br />Trail and Sid~wak Construction. The DEVELOPER recognizes the future need <br />for a trail link from the sidewalk on the west side of Xldmo Street north to eventually <br />connect with the bituminous trail being developed parallel to T.H. #47. The <br />DEVELOPER and the CITY have identified two general alignments for said trail link: 1) <br />within the T.H. ~g47 right-of-way, parallel to Ouflot E; 2) along the common property line <br />between Ouflot E, River's Bend 3rd Addition and Lot 1, Block 1, River's Bend 4th <br />Addition. Until such time as an exact trail link aligment is determined, the DEVELOPER <br />agrees to provide the CITY with a twenty-five (25) foot wide easement, in recordable <br />form, along the east boundary of Ouflot E that grants the CITY the authority to construct <br />said trail link within said easement. The DEVELOPER herein agrees to provide said <br />easement prior to recording the Plat. In the event the trail link is constructed within the <br />T.H. #47 right-of-way, the CITY will vacate said easement on Ouflot E. <br /> <br />The DEVELOPER shall be responsible for the cost of extending the sidewalk from <br />River's Bend 3rd Addition through the Plat. <br /> <br />Improvements to be Constructed by Developer, The DEVELOPER shall be <br />responsible, at its expense, for rough grading of all lots and streets in accordance with the <br />grading plan consisting of one (1) sheet drawn by Peter Raatikka, P.E., dated January 30, <br />1993. The grading plan shall be revised to indicate the lowest walkout floor elevations and <br />sediment control during construction, and insure that overland drainage shall not exceed <br />700 feet, provide a minimum of two backyard drains to drain the rear yards of Lots 3, 10, <br />11 and 12. The DEVELOPER shall also be responsible, at its expense, for installation of <br />gas, telephone, and electric utility improvements, with the exception of street lights.
