EXHIBIT A <br /> <br />FOX KNOLL SPECIAL ASSESSMENT AGREEMENT <br /> <br /> TH. IS AGREEMENT made this__ day of , 1995, by and <br /> <br />between the City of Ramsey, a Minnesota municipal corporation (hereinafter referred to as the <br />"Cie"), and Residential Development, Inc. <br /> : WITNESSETH: <br /> WHEREAS, Residential Development, Inc. (hereinafter referred to as "Owner") is the <br />owner of certain real property in the City of Ramsey, legally described as follows: <br /> <br /> : Lots 1, 2, 3, 4, 5, 6 and 7, Block 1; Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 12, 13, 14 and 15, <br /> Block 2; Outlots A and B; Fox Knoll, Anoka County, Minnesota; and <br /> WHEREAS, the Owner desires to subdivide and develop the Subject Property; and <br /> <br /> ~ WHEREAS, the development of the Subject Property will require the construction of <br /> certain public improvements, generally including sanitary sewer, storm drainage facilities, water <br /> mains and appurtenances, streets with concrete curb and gutter, sidewalks, trail and street lights <br /> (hereinafter referred to as the "Improvement Project"); and <br /> ? <br /> WHEREAS, a public hearing on the Improvement Project was duly held on <br /> t995; and <br /> WHEREAS, the Owner wishes for the City to construct the Improvement Project without <br /> notice of hearing or hearing on the special assessments levied to finance the Improvement Project, <br /> and fo levy 100% of the cost of the Improvement Project against the Subject Property; and <br /> -~ WHEREAS, the City is willing to construct the Improvement Project as requested by the <br />Owner without such notice or hearing, provided the assurances and covenants hereinafter stated are <br />made by the Owner to ensure that the City will have valid and collectable special assessments to <br />f'mance the cost of the Improvement Project; and <br /> WI-12EREAS, were it not for the assurances and covenants hereinafter provided, the City <br />would not construct the Improvement Project without such notices and hearings and is doing so <br />soleiy at the behest, and for the benefit, of the Owners; <br /> NOW, THEREFORE, ON THE BASIS OF THE PREMISES AND THE MUTUAL <br />COVENANTS AND AGREEMENTS HEREINAFTER PROVIDED, THE PARTIES HERETO <br />AGREE AS FOLLOWS: <br /> <br /> I. Owner hereby petitions the City for consamction of the Improvement Project on the <br />Subject Property. <br /> <br /> 2.
