The above was the last we heard about Fox Knoll until contacted by Residential <br /> Development, Inc. Apparently Mr. Kteckner has sold (in some fashion) the property to a <br /> different developer who looks at the plat differently. <br /> <br /> I am concerned about this issue in that assertions have been made that I coerced the <br /> deVeloper into doing something inappropriate. This is not the case. We made a <br /> recommendation to Council; received Council direction; followed Council direction and the <br /> deVeloper made a decision on his own regarding the issue. The result is a new developer <br /> who I first met on March 30, 1995, at the Haubrich Addition neighborhood meeting. <br /> <br /> It should also be noted that this same situation (urban subdivision with rural access) does <br /> not appear to be possible anytime too soon. Please review the MUSA map. There is not <br /> anBther subdivision within the existing MUSA that must be accessed for urbanization of <br /> adjacent parcels. Further, additional MUSA expansions will be to the west and south of <br /> 153rd where rural subdivisions do not exist. Finally, this whole issue has impacts upon <br /> sig parcels, three of which are in favor of the project. <br /> <br /> A result of the above, however, is that a few people have come forward desiring to forward <br /> ~environmental discussion. I will be meeting with one of these persons on May 5, 1995. <br /> It could very well be that a positive outcome will result from all of this as a result of the <br /> environmental issue perhaps rising to the surface. <br /> <br /> Windemere Woods <br /> E~rly in I995, residents of Windemere Woods requested Council action regarding the <br /> pr°perty at 5860 - 141st. Lane N.W. As a result, we wrote the attached correspondence. <br /> TO date, the status of the issue is that we have retained an escrow from A1 and Alice <br /> KOenig, the developers of Windemere Woods to provide for the completion of driveway <br /> paving at this property which they own. <br /> <br /> Also attached is a 1/19/95 letter from Tom Pertler, Assistant City Attorney, regarding the <br /> issue. <br /> <br /> Mr. Koenig has requested release of the escrow which he believes we retained <br /> inappropriately. Further, he requests payment of interest on the escrow retainage. Under <br /> Ordinance #84-13, the City policy is not to provide interest on escrows. <br /> <br />The neighborhood desires exterior improvements to the land and structure. We are not <br />aware of any leverage to cause said improvements other than the above. Mr. Koenig, has <br />however, expressed an intent to cause both exterior and interior improvements to occur. At <br />th!s point, this has not occurred, but I believe Mr. Koenig intends to begin remodeling in <br />May or June. <br /> <br />What I'm asking of Council is as follows: <br /> <br /> Do you have any problem with how this has been handled to date? <br />2): Do you have direction at this point or what additional information do you require? <br />3} What, ff any, research or action do you wish regarding escrow interest? <br /> <br />Snow Plowing <br /> <br />E~ch year we receive various snow plowing complaints. This year wasn't too bad due to <br />la~k of snow, but instead, we received several icy road complaints. <br /> <br />On occasion, Council will receive calls directly from citizens regarding concerns in this <br />area. In response to this, for the next snow season, Public Works Supervisor Mevissen <br />will ensure that GIS route maps are provided to Council with route assignments on the map <br />o~ map attachment.
