Schroeder, City Administrator <br /> <br />CASE <br /> <br />At the last meetJ~ng, it was presented that we had received a Charter amendment petition <br />dated May 23, 1995. This petition, attached, was presented to the Charter Commission on <br />June 1, 1995. It~is expected that the signatures will be verified prior to the June 13, 1995 <br />meeting. <br /> <br />Pursuant to State law, the Charter Commission received the petition and forwarded it to the <br />Council. The Ca, until must then hold an election on the petition within 90 days of receipt. <br />At this point, w9 are not certain which day represents your receipt for purposes of the <br />election (May 23,~ June 1, or June 13). That being the case, we are assuming 90 days from <br />the earliest date, br August 21, 1995. <br /> <br />Council must, bY~ resolution, schedule the election at least 30 days prior to and provide for <br />pubhshed nouce!thereof. At th~s point, we are expecung to schedule this election at your <br />June 27, 1995 m~efing. <br /> <br />Council also has the opportunity to negotiate alternative language with the circulating <br />committee prior lo the election. You may also pass upon the requested language to avoid <br />the election. ~ <br /> <br />Our bond couns~, Mr. David Kennedy and also the Charter Commission Chair Mr. Bernie <br />Stephen, have b~th questioned the constitutionality of the petitioned language.
