J <br />�1 <br />5. REQUIRED IMPROVEMENTS. The Permittee shall construct and install the <br />following site improvements on the Site in accordance with the specifications and location <br />' as shown oni,the Site Plan and Grading Plan The Required Improvements are as follows: <br />a, Site grading in accordance with the approved Grading Plan prepared by <br />' <br />Hak son Anderson Associates dated May 16,1995.Revision Date June 16, 1995. <br />b. Ins ation of bituminous driveways and parking lots. <br />C. Ins ation of B -612 continuous concrete curbing around the perimeter of <br />' all bituminous surfaces. <br />d. Establishment of turf in areas disturbed during construction. <br />e. Lan4caping in accordance with the approved Landscape Plan prepared by <br />Hak4nson Anderson dated June 5, 1995. <br />r <br />( "Required Improvements) <br />6. FIRE LANDS. Fire lanes shall be maintained on the Site. The exact location of these <br />' items on the 'Site shall be as directed by the City's Fire Chief. <br />r <br />7. LIGHTING. Any lighting installed on the site is subject to prior approval by the City <br />' Engineer. <br />8. BUILDING FACADE. The Permittee agrees to construct the structure of painted rock <br />' face concretg block in accordance with building elevations prepared by Lampert Architects. <br />9. REQUIRE U ENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />' OCCUPAN Y. No building permit for the Site will be issued until the permittee has: a) <br />signed and returned this Development Permit; b) provided the required financial guarantee <br />in accordanc a with Paragraph 11 of this Permit. No Certificate of Occupancy for the <br />structure wil be issued until the Required Improvements are accepted by the City and the <br />landscaping Inaintenance guarantee has been provided in accordance with Item #12 of this <br />' DevelopmenPermit.. <br />10. IMPROVE�AENT CONSTRUCTION SCHEDULE. The Required Improvements <br />' shall be com�leted before June 30, 1996. <br />11. ESCROW f OR REQUIRED IMPROVEMENTS. In order to insure the installation <br />' of the Required Improvements in accordance with City specifications and in a timely <br />manner, the Permittee shall be required to deposit with the City a cash escrow or letter of <br />credit, appro ed as to form by the City, in the amount of Fifty Seven Thousand Dollars and <br />' no cents ($5 ,000.00), which is 150% of the City's estimated cost of the Improvements. <br />Prior to the issuance of the building permit, all financial guarantees must be provided as <br />required herein. <br />Upon completion of the construction of the Required Improvements, the financial guarantee <br />shall be retl ped to the Permittee and the Permittee shall be required to provide the <br />landscaping maintenance guarantee described in Item #12 of this Development Permit. The <br />' determinati4 of completion of the construction of the Required Improvements shall be <br />made by thet City Council after consultation with the City Engineer. In the event the <br />Permittee fails to construct and install the Required Improvements as required herein, the <br />' City Council order the completion of the Required Improvements with City day labor <br />and/or by lep *ng contracts for said completion and draw upon the escrow for payment. <br />Only the City Council shall have the authority to direct completion of the Required <br />Improvemen s and withdraw from the escrow account. The Permittee hereby grants <br />' permission d a license to the City and/or its contractors and assigns to enter upon the Site <br />for the pu ose of completing the construction and installation of the Required <br />Improvemends in the event of the Permittee's default. <br />�1 <br />
