J �1 5. REQUIRED IMPROVEMENTS. The Permittee shall construct and install the following site improvements on the Site in accordance with the specifications and location ' as shown oni,the Site Plan and Grading Plan The Required Improvements are as follows: a, Site grading in accordance with the approved Grading Plan prepared by ' Hak son Anderson Associates dated May 16,1995.Revision Date June 16, 1995. b. Ins ation of bituminous driveways and parking lots. C. Ins ation of B -612 continuous concrete curbing around the perimeter of ' all bituminous surfaces. d. Establishment of turf in areas disturbed during construction. e. Lan4caping in accordance with the approved Landscape Plan prepared by Hak4nson Anderson dated June 5, 1995. r ( "Required Improvements) 6. FIRE LANDS. Fire lanes shall be maintained on the Site. The exact location of these ' items on the 'Site shall be as directed by the City's Fire Chief. r 7. LIGHTING. Any lighting installed on the site is subject to prior approval by the City ' Engineer. 8. BUILDING FACADE. The Permittee agrees to construct the structure of painted rock ' face concretg block in accordance with building elevations prepared by Lampert Architects. 9. REQUIRE U ENTS FOR BUILDING PERMIT AND CERTIFICATE OF ' OCCUPAN Y. No building permit for the Site will be issued until the permittee has: a) signed and returned this Development Permit; b) provided the required financial guarantee in accordanc a with Paragraph 11 of this Permit. No Certificate of Occupancy for the structure wil be issued until the Required Improvements are accepted by the City and the landscaping Inaintenance guarantee has been provided in accordance with Item #12 of this ' DevelopmenPermit.. 10. IMPROVE�AENT CONSTRUCTION SCHEDULE. The Required Improvements ' shall be com�leted before June 30, 1996. 11. ESCROW f OR REQUIRED IMPROVEMENTS. In order to insure the installation ' of the Required Improvements in accordance with City specifications and in a timely manner, the Permittee shall be required to deposit with the City a cash escrow or letter of credit, appro ed as to form by the City, in the amount of Fifty Seven Thousand Dollars and ' no cents ($5 ,000.00), which is 150% of the City's estimated cost of the Improvements. Prior to the issuance of the building permit, all financial guarantees must be provided as required herein. Upon completion of the construction of the Required Improvements, the financial guarantee shall be retl ped to the Permittee and the Permittee shall be required to provide the landscaping maintenance guarantee described in Item #12 of this Development Permit. The ' determinati4 of completion of the construction of the Required Improvements shall be made by thet City Council after consultation with the City Engineer. In the event the Permittee fails to construct and install the Required Improvements as required herein, the ' City Council order the completion of the Required Improvements with City day labor and/or by lep *ng contracts for said completion and draw upon the escrow for payment. Only the City Council shall have the authority to direct completion of the Required Improvemen s and withdraw from the escrow account. The Permittee hereby grants ' permission d a license to the City and/or its contractors and assigns to enter upon the Site for the pu ose of completing the construction and installation of the Required Improvemends in the event of the Permittee's default. �1
