J <br />and "Stage W Improvements. <br />' NOVA, THEREFORE, the CITY and DEVELOPER agree as follows: <br />I. <br />' STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES: <br />1. City To Order Improvements. The CITY will order the improvements to be <br />constructed and direct the City Engineer to prepare plans and specifications and advertise <br />for bids and will award a contract for the construction of the Stage I Improvements to the <br />' lowest responsible bidder. <br />' 2. Incorporato6 of All City Code Requirements. That the recitals above and the <br />provisions ot, the City Charter, Subdivision Code Zoning Code and Public Improvement <br />Code of the 61T as amended to date hereof, are incorporated herein by reference. <br />1 <br />i <br />' 3. Additional Right of Way and Easements. The DEVELOPER herein agrees to <br />dedicate, on �he final plat, an additional twenty-seven (27) feet of right of way along the <br />eastern boundary of Lot 3. The DEVELOPER also agrees to provide the CITY with a <br />' twelve (12) frpot wide easement for drainage, utility and trail purposes along the eastern <br />boundary of tots 1 and 2 of the Plat. The DEVELOPER herein agrees that the Plat shall <br />' not be releas by the CITY for recording until said easement has been provided in a <br />separate, recordable document. <br />4. Improvements to be Constructed by City. The CITY agrees to construct the <br />requested Stage I Improvements as petitioned for by the DEVELOPER. The Stage I <br />' Improvementk to be constructed are as follows: municipal water and sanitary sewer trunk <br />and laterals. <br />1 <br />5. Improvements_ to be Constructed by Developer. The DEVELOPER shall also be <br />' responsible, pt its expense, for installation of gas, telephone, and electric utility <br />improvement. The DEVELOPER shall also be responsible for obtaining access permits <br />' from the State and County and constructing any access improvements required as a <br />condition of t�ese permits. The DEVELOPER shall be responsible for constructing any <br />interior drainage improvements. It is anticipated that such drainage improvements will be <br />' installed alonj with site improvements on individual parcels. The DEVELOPER must, <br />however, insu a that necessary internal easements are in place to conduct the runoff to the <br />' westland located on the western portion of the parcel.
