CASE # /Z <br />J REQUEST FOR ;A CONDITIONAL USE PERMIT TO GRADE AND EXPORT <br />i I SOILS; CASE OF NORTH FORK, INC. <br />By: City Enginpeer Steve Jankowski and Zoning Administrator Sylvia Frolik <br />' Background: <br />On May 16, 1995, the�City received an application from North Fork, Inc. to grade and export soils <br />from Lots 3 and 4, Block 2, Northfork Lake Addition. The purpose of the project is to create more <br />attractive building sites. <br />The following items are enclosed for your information: <br />a) Site lobation map <br />b) Applicant's letter and attached Grading Plan <br />c) PropoJed findings of fact <br />d) Propoted conditional use permit <br />' Notification: <br />Conditional Use Permits are required to be subjected to public hearings with all properties within <br />350 feet being notifirpd of the public hearing. In this case, Staff attempted to notify all property <br />owners within 600 feet of the subject property of the public hearing conducted by the Planning <br />Commission on Jund 6. There were no written or verbal comments received from residents at the <br />hearing. <br />Observations: <br />' The applicant is pro osing to strip the topsoil over an approximate two acre area and remove and <br />export approximate 16,000 cubic yards of materials to create walkout building pads closer to the <br />front of the two affected lots. The material would be removed from the site by hauling belly <br />dumps down Inverness westward for a distance of approximately 800 feet, and from there would <br />be hauled across o Clot and golf course property to the northern boundary of the Burlington <br />Northern right of 4y, and then onto 153rd southward to U.S. #10. The applicant would also be <br />allowed to utilize thlo material in the grading of the outlot in accordance with the approved grading <br />plan. This haul roue would minimize the impact to the residents of Northfork. <br />F <br />The Planning Commission has recommended that the grading and hauling operation and restoration <br />be confined to a four week period from start to finish. <br />r <br />Silt fence and oth ' erosion control measures should be required to protect adjacent properties. <br />The revised gradinjwould not affect existing drainage patterns. <br />' Recommendatiof►: <br />City Staff and the Planning Commission recommend approval of th permit. <br />Council Action: ) <br />C W� <br />Motion to: * 1 1 ) v <br />Adopt Finings of Fact # relating to North Fork's r mi <br />request for a conditional use et <br />to grade and export soils in Northfork Lake. p <br />a59 <br />
