He stated "these kids should not <br />be pigeon -hoI ; they deserve a chance ". Mr. McLafferty stated he is asking for a <br />' conditional use ermit - not a spot zoning. He is asking for two more children and added <br />that he has the Pouse, the expertise, and the love for kids. He reiterated that these are <br />teenaged boys a d it is hard to find homes for them. He declared that he is a full -time, <br />foster care paren and he is willing to sign a form stating that there will not be 10 to 20 kids <br />' living in his hone. He inquired if anyone would tell someone they couldn't have eight <br />kids. <br />Motion by Counoilmember Zimmerman and seconded by Councilmember Peterson to adopt <br />' Resolution #95- 4 -076 adopting Findings of Fact #0375, as amended, relating to Patrick <br />McLafferty's request for a conditional use permit for a group foster home to accommodate <br />' eight youth in a mgle family residential. The amendment is to Item #12 and should state <br />that in 1977 the approved two duplexes in the single family district and in 1993 and <br />1994, two permits for accessory apartments in the single family district were approved. <br />Motion carried. (Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Peterson and <br />Beahen. Voting �4o: Councilmember Beyer. <br />' Motion by Couniilmember Peterson and seconded by Councilmember Zimmerman to deny <br />Mr. McLafferty'k request for a conditional use permit to operate a group foster home in a <br />single family dis�rict that would serve eight persons, based on the findings of fact. <br />' Motion carried. ,Voting Yes: Mayor Hardin, Councilmembers Peterson, Zimmerman and <br />Beahen. Voting �4o: Councilmember Beyer. <br />Case #5: Adopt Ordinance to Rezone Certain Property from B -1 <br />' Business to B -2 Business; Case of Polka Dot Dairy and Rum <br />Raver Properties <br />' Zoning Adminis rator Frolik reminded Council that at their last meeting, they adopted a <br />findings of fact elating to the request of Polka Dot Dairy and Rum River Properties to <br />rezone property at the northwest corner of the intersection of T.H. #47 and C.S.A.H. #116 <br />' from B -1 Busi n -.ss to B -2 Business to facilitate development of the property with a <br />convenience stor. At that time, an ordinance was introduced to rezone the property. <br />' Motion by Coun4ilmember Zimmerman and seconded by Councilmember Beahen to adopt <br />Ordinance #95 -08 rezoning certain property from B -1 Business to B -2 Business. <br />Motion carried. ''doting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer <br />and Peterson. carried. <br />No: None. <br />Case #6: Request for Preliminary Plat Approval of Fox Knoll; Case of <br />Rick Murray, Residential Development Company, and Mark <br />Kleckner, Fox Development Co. <br />Zoning Administiator Frolik stated that Rick Murray of Residential Development Company <br />' is requesting preliminary plat approval of Fox Knoll. The plat consists of 23 acres to be <br />subdivided into 22 lots. All of the lots exceed the minimum area and dimensional <br />requirements. Street access to the lots will be provided by an extension of 151st Lane <br />' N.W. which wi result in exceeding the 600 -foot maximum dead -end street length. <br />Another cul -de- ac will be extended north off of 151st to access the remainder of the <br />developable pro. rty.
