Mr. <br />Hendriksen stato he was trying to be cooperative and somehow the whole issue has <br />snowballed into mething it was not intended to be. He reiterated that he honestly thought <br />it was an offer. <br />Mr. Goodrich re' $P onded that it is an offer as long as the City Council or City Staff wants <br />him to review it. <br />' Mr. Hendriksen Felt that it should be reviewed by Mr. Goodrich. He added that he has <br />obtained his ownj legal counsel so he knows this amendment is constitutional. <br />' Motion by CounOmember Beahen and seconded by Councilmember Zimmerman to refer <br />the proposed cha�ter amendment to the Charter Commission. <br />' Motion carried. �oting Yes: Mayor Hardin, Councilmembers Beahen, Zimmerman, Beyer <br />and Peterson. Vine No: None. <br />' Case # 14: 00tion Agreement Approval <br />City Administrat, r Schroeder stated that the City will be constructing sanitary sewer and <br />' water lines out to! the Anoka Electric Cooperative (AEC) facility during the summer 1995. <br />This extension cif utility lines will require the acquisition of easements across certain <br />properties located along the Burlington Northern Rail lines. It is intended that this <br />construction will oincide with the placement of the new electric line for the Anoka Electric <br />' Utility and the c mbination, of the existing AEC transmission lines. Mr. Greenberg, the <br />owner of the par 1 abutting Sunfish Lake Boulevard, has indicated that the entire 6.5 -acre <br />parcel could be acquired for $20,000 plus back taxes (estimated at $13,848.04) or $5,207 <br />' per acre. The ovW,ner has also stated that the payment could be delayed until a future date. <br />The proposed opon agreement indicates a September 1, 1995 payment, with the property <br />transfer occurn r within 60 days. He explained that the City will need to acquire an <br />' estimated 1.8 a s for the utility/roadway easements to extend the lines across the property <br />and to gain an 8 'McKinley Street right -of -way. In addition, the City would gain clear <br />title to Azurite Street as a portion of a land purchase. The estimated purchase price of <br />McKinley/Utilit. acquisition is $6,300 plus costs. Mr. Schroeder suggested this fee <br />' purchase of the property represents an excellent value given its location expenditures for <br />accessory easemee�onnts and Anoka Municipal Utility future easements. <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to <br />authorize option/' urchase agreements for the parcel abutting Sunfish Lake Boulevard and <br />the 1.8 acres for a utility/roadway easements to extend the lines across the property and to <br />' gain an 80' McKinley Street right -of -way. <br />Further discussion. Mayor Hardin inquired of Mr. Schroeder how difficult he felt it would <br />be to resell the p operty. Mr. Schroeder replied that we have one lot spoken for but that <br />' this is a more di lficult piece to sell. Mayor Hardin expressed a concern about that and <br />inquired about so 1 testing. Mr. Schroeder stated that the testing is a part of the clear title. <br />' Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer <br />and Peterson. Voting No: None. <br />Case #15: Roport from Fire Board <br />City Administrator Schroeder presented a report from the Fire Board. The Board received <br />an update on a dr*g and alcohol policy and Staff will be working on a City-wide policy for <br />1 City Council/April 25, 1995 <br />Page 21 of 23 <br />a <br />5 �7 <br />
