C°uncilmember <br /> <br />A RESOLUTION <br />REQUEST FROM <br />FOR GRADING <br /> <br /> introduced the following resolution and moved for its adoption: <br /> RESOLUTION #95-07- <br /> <br />ADOPTING FINDING OF FACT # RELATING TO A <br />NORTH FORK, INC. FOR A CONDIT--Ti-ONAL USE PERMIT <br /> <br /> WHEREAS, the City of Ramsey received an application from North Fork, Inc. for a <br />conditional use permit for grading on the property legally described as follows: <br /> <br /> Lots 5, 6, 7 and 8, Block 3, NORTHFORK LINKS ADDITION, Anoka County, <br />Minnesota. <br /> (the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS <br />CITY OF RAMSEY, ANOKA COUNTY, STATE <br />findings of fact relating to the request are determined <br /> <br /> CITY COUNCIL OF THE <br />OF MINNESOTA that the <br /> to be as follows: <br /> <br />That on May 16, 1995, North Fork, Inc., hereinafter referred to as "Applicant", has <br />properly applied for a conditional use permit to grade soils in the Northfork Planned Unit <br />Development District. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on June 6, 1995, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated. <br />as a part of these fundings by reference. <br /> <br />That the subject property is located in a residential area of a Planned Unit Development and <br />is approximately 8 acres in size. <br /> <br />4~ <br /> <br />That Section 9.11.18 (Grading, Mining and Filling Permits) states that a conditional use <br />permit shall be required to grade individual lots by more than 3 feet in depth, fill individual <br />lots by more than 2 feet at any point, and excavate more than 400 cubic yards of earth <br />material. <br /> <br /> That the grading plan submitted proposes to regrade the Subject Property to create walkout <br /> building sites.g sites. <br /> : <br /> <br /> That the Applicant is proposing regrade the subject property to raise the front elevation of <br /> the building pads from 880'/882' to 887'/888'. <br /> <br />7 That no materials are proposed to be imported to or exported from the site. <br /> That no blasting will be employed in the grading activity. <br /> That no excavation will take place within the road right-of-way. <br /> <br />10. That the grading plan indicates that an 879.8' elevation will be maintained along the lot line <br /> between Lots 7 and 8 to ensure drainage to a catch basin located along Andrie Street. <br /> <br />1!.
