This financial guarantee may be used by the City to pay <br />for the coist and expense of repairing any public right of ways due to the mining operation, <br />pay for a~y cost associated in administering the requirements of this Chapter of the City <br />Code, ar/d to pay for any restoration of the worksite not properly restored upon <br />complefidn. <br /> <br />The permit Holder shall implement sediment and erosion control practices. No grading <br />activity s~all occur within twenty-five (25) feet of a property line unless silt fence is placed <br />along the ~roperty line to prevent sexliment from washing onto the adjoining property. Any <br />erosion Which causes gullies of greater than one (1) foot within twenty-five (25) feet of a <br />property line shall be regraded within forty~eight (48) hours of the precipitation event that <br />caused the erosion. <br /> <br />There shall be no stockpiling of graded materials, other than the topsoil on a tempoary <br />basis, allcjwed within the boundaries of the P.U.D. <br /> <br />The perr~i~'t holder shall file with the City a liability insurance policy or certificate of such <br />insuranca, acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br />a. The Policy shall insure the permit holder for the sum of at least $300,000 for injury to <br /> one person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />b. Said l~olicy shall be for the full period of the permit and shall provide for the giving of <br /> 10 d~ys prior notice to the City by registered mail of termination, cancellation or <br /> amenflrnent of the policy. <br /> <br />c. In th~ event said policy is terminated for any reason, the permit shall be automatically <br /> suspei'~ded upon the day the policy terminates unless a new policy complying with this <br /> item is obtained and filed with the City prior to the termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the worksite shall be within the limits set by <br />the Minnesota Pollution Control Agency and the Environmental Protection Agency of the <br />United States. <br /> <br />All costs incurred by the City in executing and administering this permit shall be the <br />responsib.'ility of the permit holder. The permit holder shall maintain a minimum Five <br />Hundred!Dollar ($500.00) balance in an escrow account with the City. This escrow shall <br />be used tO reimburse the City for expenses incurred in the administration of this permit. At <br />the time [he grading operation and site restoration are completed to the satisfaction of the <br />City, the balance of the escrow shall be returned to the Permit Holder. <br /> <br />All gradigg operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only <br />unless oth, erwise specifically approved by the City Administrator and/or his designee. <br /> <br />The amount of dust or other particulate matter caused by the mining operation shall not <br />exceed tlie standards established by the Minnesota Pollution Control Agency. No operation <br />shall be ~llowed when wind gust exceed 30 miles per hour. <br /> <br /> <br />
