WHEREAS~ the DEVELOPER desires to construct the Stage I and Stage <br />)rovements, except for those Stage II Improvements constructed by the CITY. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br /> <br />II <br /> <br />.(29.nformance with Plan. The Plat. shall be developed pursuant to the final <br />plat consisting of two (2) sheets, prepared by Bradley J. Canaday Surveying~ <br /> <br />Incorporation of All City Code Requirements. That the recitals above and <br />the provisions of the City Charter, Subdivision Code, Zoning Code and Public <br />Improvement Code of the CITY as amended to date hereof, are incorporated herein <br />by reference. <br /> <br />Stage I Improvements Required. The DEVELOPER agrees to construct the <br />required Stage I Improvements according to the terms and conditions of this <br />contract and in accordance with DEVELOPERS' plans submitted to the CITY. <br />Said plans shall be in general conformance with the Final Grading Plan prepared by <br />Ulteig Engineers, Inc., dated June 27, 1995 and Storm Sewer and Street <br />Improvement Plans for Royal Road and 162nd Circle and 162nd Court dated June <br />28, 1995. <br /> <br />The DEVELOPER shall be responsible for certifying to ail purchasers and <br />assignees of individual lots within the Plat of the need to prevent drainage from the <br />roadways onto their properties by proper grading of their respective driveways. <br /> <br />Boulevard and Area Restoration. The DEVELOPER shall be responsible <br />for the cost of establishing seed or sod in ail boulevards within thirty (30) days of <br />the completion of the street improvements, and restore all other areas disturbed by <br />the development grading operation in accordance with the approved erosion and <br />sediment control plan. The DEVELOPER shall aiso be responsible for the cost of <br />cleaning any soil, earth or debris from the wetlands within and adjacent to this Plat <br />resulting from grading performed in the development of the land. Any silt fencing <br />utilized in the project for erosion and sexlimentation control shall be removed within <br />twelve (12) months of the CITY'S acceptance of the Stage I Improvements. <br /> <br />Requirements after Street Surfacing. After the street surfacing is instailed, <br />the DEVELOPERS shall clear any soil, earth, or debris from the streets and from <br />the lots within the Plat resulting from any construction on the Subject Property by <br />the DEVELOPERS or their successors and assigns. <br /> <br />Rem. Qyal of Debris, The DEVELOPER shail be responsible for the removai <br />and proper disposal of all debris, garbage, and fallen trees from the Subject <br />Property. <br /> <br />City Code Compliance. That the DEVELOPER will develop the Plat in <br />accordance with the City Code, Section 9.50, entitled "Subdivision" <br /> <br /> <br />
