The subdi¥ision is areplat of commercial Lots 1, 2, 6 and 7, Block 4, Riverside West, into <br /> one commercial'[lot and two residential lots. As a courtesy, the <br />remainder of the parcels on the subject block and the parcels on the east side of Dolomite were <br />provided with a c~py of the case that was submitted to the Planning Commission on June 8. There <br />have been no written or verbal responses received at the City as a result of the mailing. <br /> <br />Observations: <br /> <br /> IThe Superbowl structure currently occupies portions of Lots 1, 2, 6 and 7. The purpose of the plat <br /> is to achieve on{ large commercial lot to accommodate the Superbowl facility and plat the <br /> remainder of the ~ropeny into two residential lots. . <br /> <br /> All of the lots in the proposed plat exceed the minimum area and width requirement for commercial <br /> and residential lot~ in the urban district and the Superbowl structure will meet all required setbacks <br /> from property lin~s. However, Section 9.11.20 of the City Code requires that all commercial uses <br /> maintain a 40 foot yard from residential uses. The owner of Superbowl has stated an intent to <br /> move the volleyball court north a sufficient distance to provide for that 40 foot buffer between the <br /> court and Lot 2. i Per the developer's offer, the development agreement will also require the <br /> erection of a priv~y fence between the volleyball court and Lot 2. <br /> <br /> Superbowl is cu~ently connected to municipal services and the proposed residential lots will be <br /> required to connect to the services when developed. Park dedication will be a pro rata cash <br /> payment based o~ previous park fees paid with the platting of Riverside West. <br /> Recommendation: <br /> <br />The Planning Corflmission and City Staff recommend final plat approval. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Reiolution ~$95-07- granting final plat approval to Riverview Bowl contingent <br />upon the developer entering into a development agreement with the City. <br /> <br />Review Checklist: City Engineer <br /> <br />CC: 7/11/95 <br /> <br /> <br />
