The final plat consists of one <br />sheet dated received by the City on June 22, 1995. We offer the following comments: <br /> <br />I. General: The subject plat is a replat of Lots 1, 2, 6 and 7, Block 4, Riverside West that <br /> received sketch plan approval from the Planning Commission on June 8, 1995. Currently, <br /> the Superbowl structure and use encroaches onto all four of the above listed lots. The <br /> purpose of the replat is to achieve one large commercial lot for the Superbowl structure and <br /> create two urban residential lots from the remaining property. <br /> <br />2. Zoning: The subject property is currently zoned B-3 Highway Business. Application has <br /> already been submitted for a rezoning to develop the two southerly lots with residential <br /> uses. The rezoning will be submitted to the Planning Commission in August. <br /> <br />3. Lot Sizest The commercial lot exceeds the 1/2 acre minimum lot size requirement and the <br /> }wo proposed residential lots exceed the 10,800 square foot minimum. <br /> <br />4. Lot Dimensionst All of the lots exceed the minimum dimensional requirements for <br /> commercial and residential lots in the urban district. <br /> <br />5. Structure Setbacks: Lot 1 is drawn in such a way that the Superbowl structure will no <br /> longer encroach on property lines and will meet all structure setback requirements for the B- <br /> 3 Highway Business District. <br /> <br /> However, Section 9.11.20 of City Code requires a 40 foot wide yard between all <br /> commercial and residential uses. Superbowl's outdoor volleyball court comes within 40 <br /> feet of Lot 2 and the development agreement will require moving the court a sufficient <br /> distance north in 1996 to meet the 40 foot buffer requirement. The development agreement <br /> will also include the developer's offer to erect a privacy fence between Superbowl and Lot <br /> 2. <br /> <br />6.
