feet; thence northeasterly along a tangential curve, concave to the east, baying a radius of 383.21 feet and having a total central angle of 92 degrees, 27 minutes, 24 seconds, for a distance of 98.58 feet, more or less, to the South line of the duly recorded plat of Brookview Estates and there terminating. Also Excepting therefrom that part of said South Half of the Northeast Quarter lying within said plat of Brookview Estates. AND WHEREAS, said application is made pursuant to City Code Chapter 1~0.014G, Planned Unit Development; and WHERFAS, on the 2nd day of August, 1983, the Planning and Zoning Com- mission held a public hearing on the application for the P.U.D. and rezoning which public hearing was properly published in the City's legal newspaper on the 22~d day of July, 1983; and WHEREAS, the City's Planning and Zoning Commission met on the 2nd day of August, 1983 at which time it reviewed the P.U.D. application and made a w~itten recommendation to the City Council that the preliminary development plan for the P.U.D. be approved; and WHEREAS, at its regular City Council meeting on August 23, 1983, the CitY Council gave preliminary approval of the plan; and WHEREAS, at its regular City Council meeting held on November 13, 1984 the City Council adopted Resolution 984-223 which is a resolution approving the amended preliminary plan for the Rum River Hills P.U.D.; and WHEREAS, at its regular meeting on December 4, 1984, the City's Plan- ning and Zoning Commission found that the final P.U.D. was in substantial com- pliance with the plan it had given preliminary approval to on August 2, 1983; and WHEREAS, the entire P.U.D. shall be subject to restrictive covenants and oonditions in order to maintain the appearance of the development. Nm ~IqEREFORE, BE IT RESOLVED BY 5HE CITY COUNCIL OF 5HE CITY OF RAMSEY, ANOKA ~NTY, S~ATE OF MINNESOTa, as follows: i 1) That final approval of the Rum River Hills Planned Unit Develop- m~nt is hereby granted subject to the following: a) That Rum Eiver Hills Associates and City enter into a compre- hensive development agreement which agreement shall incorpo- rate all City Code requirements and City policy relating to a development of this nature; and b) That the Rum River Hills Planned Unit Development site be re- zoned to P.U.D.; and Resolution #84-240 Page 3 of 4 I I i I I I I I I I I I I I I I I I
