I
I
I
I
I
I
I
I
I
I

Neighborhood Com~atibili .ty:

The structure is a r.~ bler design with vinyl siding and fiberglass shingles. Aesthetically speaking,
the proposed structm', e is compatible with the existing home in Pineview Estates 2nd Addition and
the residential development on the north side of 149th.

.Access;

The Mertens have informed staff that the certificate of survey is in error; they are proposing that
their driveway be located on the east property line rather than the west. The covenants for
Pineview Estates 2fid Addition requires the Mertens to have a common driveway on the west
property line with l.~ot 7. The common driveways are to be 30 feet wide, 15 feet on each side of
the common properS, lines. (I believe the intent of the common driveway concept was to limit the
number of accesses! onto 149th because of the commercial traffic that would be associated with
them and a 30 fo~t wide driveway would be more accommodating to some of the larger
commercial vehicles that would be using these drives). Consistent with that, Lot 9 and 10 are
supposed to have a e:ommon driveway on their common lot line.

However, the vicinity of the common line between 9 and 10 is wetland and a common'driveway
wall not be feas~blei so Lot 10 wall have to have ~ts own driveway rather than a shared driveway
with lot 9. Mr. MeOens desires to have a tuck-under garage and the only way he can do that is if
he has a driveway coming in from the east. He has proposed to the Pineview Estates 2nd Addition
Homeowners Assoi:iation (Mike Shoquist and Gilbert Menkveld) to let Lot 10 have its own
driveway, he will hitve a shared driveway with Lot 9 to the east, and in the event Lot 7 develops
with a commercialiuse that needs the 30 foot wide driveway on the common property line as
originally planned ~or, he is willing to grant an easement for the additional 15 feet needed on his
side of the property ~line. Mr. Shoquist and Mr. Menlcveld have signed an agreement accepting Mr.
Merten's proposal.,
