Substantial progress has been made
and they are now working with AEC.

Motion by Co~ncilmember Zimmerman and seconded by Councilmember Beahen to
authorize an an~endment to the transmission line alignment, contingent upon notification to
and resolution i of issues from affected property owners along the C.R. #116/C.R. #57
alignment. /

Motion carried4 Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer
and Peterson. ¥oting No: None.

Motion by Cohncilmember Zimmerman and seconded by Councilmember Beahen to
authorize a right-of-entry to AMId, contingent upon City Attorney approval.

Motion carried2 Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer
and Peterson. Voting No: None.

Case #8: purchase of Spohn Property

City Adminis~ator Schroeder stated that last November, Council authorized a purchase of
property from !groups represented by Marvin Eggum for the extension of McKinley and
Uranium Streells. We also talked about purchasing the Spohn property for McKinley Street
acquisition. Since January, the City Attorney has been negotiating with Mr. Spohn for
land ownershig. The City has offered $196,000 for the prope~y contingent upon Council
approval. Thc~'e is funding for this - it was set aside in 1991. Other funding was provided
through a bonc~ issue. If we purchase this property, it means the City will have purchased
just under 107 ~acres and will have utilized just over 28 acres. We will have used just over
26% of the property and will have just over 65 acres remaining.

City Attorney Goodrich stated that the City has actually offered Mr. Spohn $180,000 for
his property. The owner would like to retain five acres in the east comer (2 ? 2-1/2 acre
lots). Mr. SpO~hn has countered at $210,000. Mr. Goodrich stated that as of yesterday,
Mr. Spohn has suggested he would be willing to sell for $200,000. Mr. Goodrich
explained thati$200,000 amounts to approximately $5,500 per acre which is consistent
with what the City paid for Ramsey 67 property ($5,700). Staff is of the opinion that this
property is w ~oyth a little less an acre because of the access. Mr. Goodrich added thathe
had asked Mr. ISpohn to split the difference between $200,000 and $180,000 which would
be $194,000 but he was not interested in that.

Mayor Hardin inquired if Mr. Goodrich was of the opinion that $196,000 would be
rejected by Mw. Spohn also.

Councilmemb~r Zimmerman commented that we have been holding up this deal for three to
four years.

Mr. Goodrich felt that it's important to negotiate this because of the McKinley Street
extension too.~

Motion by C0uncilmember Zimmerman and seconded by Councilmember Beyer to
authorize entering into an agreement of $200,000 for the 30-acre parcel from Mr. Spohn.

Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer and
Beahen. Votidg No: Councilmember Peterson.

City Council/May 23, 1995
