Johnson RE: Rum.River Hills Golf Course Dear Mr. Schroeder: Please be advised that I represent Jerry Schmidt whose residence is located at 5831 164th Lane N.W., Ramsey, immediately adjacent to the Rum River Hills Golf Course. -As you may be aware, the owners of the Rum River Hills Golf Course are asking permission to build a large maintenance building and parking lot on the golf course abutting my client's property. In reviewing the original PUD Plan and Developers Agreement, it appears that the zoning of the particular property.in question was never addressed; and the property~where the maintenance building is to be located is zoned PUD Golf Course. I have also been informed~that the Planning staff intends to allow the. building'to be erected on the property simply with site-plan approval without a public hearing. It is our position that a public hearing is required in this matter. This proposed building was not included in the o~iginal PUD Plan; will reduce the open space in the PUD and contradicts the original Findings of Fact that were entered into prior to the approval of the PUD because this structure will have a severe detrimental effect to my client's property and the property of other surrounding property owners and may be considered an inverse taking, by the City. My client respectfully requests!that this proposed project be put on for public hearing so that the concerns of the surrounding property owners can be heard by the City Council. If this matter is not placed on for public'hearing, my client has requested that I take whatever steps are necessary in order to protect his interests. Please
