I <br />I <br />I <br />I <br /> <br />CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORT <br />SOILS; CASE OF GOOD VALUE HOMES, INC. <br /> By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />Background: <br /> <br />On July 20, 1995, the City received an application from Good Value Homes, Inc. to grade and <br />export soils fror~ what is proposed to be platted as Chestnut Ridge 2nd Addition. Chestnut Ridge <br />2nd Addition m6eived preliminary plat approval from the City on August 22, 1994 and consists of <br />65 acres propos~ to be subdivided into 72 single family lots. The purpose of the project is to <br />create more attr~ tive building sites. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Grading Plan <br />oppOSed f'mdings of fact <br /> osed conditional use permit <br /> <br />Notification: <br /> <br />Conditional Um Permits are required to be subjected to public hearings with all properties within <br />350 feet being ~otified of the public hearing. In this case, Staff attempted to notify all property <br />owners within 6~ feet of the subject property and all persons along the haul route that would be <br />approved by theiC-ity (Potassium St., 145th Lane, Sunfish Lake Drive). ' <br /> <br />Observations: <br /> <br />The applicant ia proposing to snip the topsoil, remove and export approximately 15,000 cubic <br />yards of materi~ls, and replace the topsoil. Silt fence and other erosion control measures have <br />been proposed toprotect adjacent properties. <br /> ; <br /> <br />The applicant has proposed that the material would be removed from the site by hauling belly <br />dumps south or~ Potassium Street N.W. and west on 145th Lane and Sunfish Lake Drive to <br />Sunfish Lake Bl~d. Because of the extremely narrow width of Sunfish Lake Drive, the applicant <br />originally proposed that empty tracks would return to the site by going north on Tungsten Street <br />N.W. off of Coflnty Road #116, east on 143rd Lane and north on Potassium. Because of the <br />substantial numSer of homes existing on the proposed ingress route, City Staff recommended that <br />the only haul roa. te be that which has been proposed by the applicant as the egress route. <br /> <br />The Planning Commission conducted a public hearing regarding the application on August 1, <br />1995. There were several residents present from the fh'st phase of Chestnut Ridge to the east <br />whose concerns ~¢re alleviated when informed by Mr. Peterson of Good Value Homes that there <br />would be no excavations in the wetlands and that there would be no more trees removed than what <br />was originally a~proved by the City Council at the preliminary plat stage. Other residents along the <br />haul route were ~sured that Good Value is responsible for leaving the haul roads in a condition <br />equal to what ~ey were at the commencement of the project. At this time, Mr. Peterson also <br />amended his prqposal for haul routes and stated that the ingress route would be the same as the <br />egress route anditraffic control measures such as flagpersons or the use of walkie talkies would be <br />used to avoid a sltuation of trucks meeting on Sunfish Lake Drive. <br /> <br /> <br />
