I
I
I
I
I
I
I
I
I
I

CASE #

TELECOMMUNICATIONS PERMIT ORDINANCE
By: Ryan R. Schroeder, City Administrator

Background:

Recently, the I~eague of Minnesota Cities and the Suburban Rate Authority prepared a
model telecommunications ordinance. The intent is to provide a vehicle wherein the City
identifies the p _'_r~edures for location of telephone and similar electronics lines within City
rights-of-way. Also, the ordinance will discuss property disruption and repair thereof.

We have also received a model ordinance from Bernick and Lifson, the QCTV attorney, s
Enclosed is a ~aft ordinance amended slightly from the LMC/SRA document to fit our
needs. This chbice was made in that there seems to be a greater likelihood of municipal
uniformity utilizing this model.

prior to preparation of this case, Attorney Goodrich has not reviewed the issue. I have also
not notified anYlaffected utilities. If you are interested in pursuing the enclosed ordinance I
would intend tO provide for that notification prior to formal introduction (as well as legal
review for conf(~rmance with other code provisions).

Council ActiOn:

Motion to direc~ Staff to schedule an introduction of a telecommunications ordinance.

Reviewed by:

City Administrator

CC: 08/08/95

/jmt

g
