cns # t 0 <br /> <br />PROPERTY ACQUISITION <br /> By: Ryan R. Schroeder <br /> <br />Background: <br /> <br />Staff has been meeting with Tom and Patty Kurak over the past few months with the intent <br />of gaining access to and control of the utility easement required for the Ramsey Elementary <br />School sewer ff!ain. Throughout the past year, we have also been discussing the upcoming <br />need to gain tlie Sunwood Drive right-of-way from the Kuraks and Ben Deemer. The <br />balance of the ~fight-of-way for this roadway was granted through the subdivision process <br />(Wood Pond Hills and Anoka Electric CoOperative with Chestnut Ridge in process) or <br />through the resolution of agreements with Waste Management of Minnesota. <br /> <br />The roadway alignment has been moving around through discussions with these remaining <br />two property owners. Hence, we have not been able to make offers on the property in that <br />we do not know the exact property descriptions. <br /> <br />However, we are now at a point on the school sewer easement where we need to force the <br />issue through ir/itiafion of the eminent domain process. As long as that needs to occur, we <br />may as well add2 Sunwood Drive to the action in that-the Kuraks own both the easement and <br />the right-of-waY areas. That leaves only the Deemer property. <br /> <br />Given the above, I have requested that Attorney Goodrich prepare condemnation <br />resolutions on ~ill three parcels (Kurak easement, Kurak right-of-way, Deemer right-of- <br />way). I have discussed this action with the property owners who are accepting of the need <br />to initiate the process. <br /> <br />Council should be aware that an eminent domain resolution does not halt negotiations. <br />What it does is.ensure that the process has an end date wherein the City controls the <br />property should;we not be able to negotiate an acceptable purchase.
