Councilmember introduced the following resolution and <br />moved for its adoption: <br /> <br /> RESOLUTION #95-08-__ <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF.PROPERTY FOR SANITARY SEWER <br />PURPOSES. <br /> <br /> WHEREAs, the City has initiated its public improvement project <br />95-13 (thei"Improvement Project") which project consists of <br />constructinq sanitary sewer trunk lines for the purpose of serving <br />various properties in the City with municipal sewer service; and <br /> <br /> WHEREAS, fee title to certain real property is required to <br />provide for~ the construction of the Improvement Project and in <br />order to further the public health, safety and convenience of the <br />residents of the city; and <br /> <br /> WHEREAS, the City has authority to acquire the real property <br />for the Public Improvement by eminent domain pursuant to Minn. <br />Stat. Chapter 117; and <br /> <br /> WHEREAs, the City has the right to acquire the real property <br />prior to the filing of an award by the Court appointed <br />commissioners, pursuant to Minn.
