In <br />fact, there has be~n a financial relationship with this company that fulfills the first elements <br />of M.S. 471.87. There is a contractual relationship between the city and t/,Js company. Our <br />investigation, however, does not reveal the type of interest by Mr. Hardin that is protn'bited <br />by the statute. Ia order to have a personal financial interest in a contract, one must be an <br />officer or sharehc~Ider of the company holding the contract with the city. We have not found <br />that Mr. Hardin [has any interest in Investment Centers. He may have an interest in a <br />company that is ~lso doing business with Invesunent Centers, Northeast State Bank. This <br />secondary interes~ is not, however, prohibited. In fact, it is likely that many members of city <br />councils do persdnal business with companies that in turn do business with the city which <br />they serve. <br /> <br />We have, therefore, concluded that in our judgment there is no criminal conduct present in <br />the facts we hav~ found and are closing our file in this matter. <br /> <br />Sincerely, <br /> <br />JJW:ds <br /> <br /> <br />
