AND WHEREAS, said application is made pursuant to City Code Chapter 170.014G, Planned Unit Development; and WHEREAS, on the 2nd day of August, 1983, the Planning and Zoning Com- miSsion held a public hearing on the application for the P.U.D. and rezoning which public hearing was properly published in the City's legal newspaper on the 22nd day of July, 1983; and W~EREAS, the City's Planning and Zoning Commission met on the 2nd day o~ August, 1983 at which time it reviewed the P.U.D. application and made a w~itten recommendation to the City Council that the preliminary development plan far the P.U.D. be approved; and W~EREAS, at its regular City Council meeting on August 23, 1983, the City Council gave preliminary approval of the plan; and WHEREAS, at its regular City Council meeting held on November 13, 1984 the City Council adopted Resolution 984-223 which is a resolution approving the amended preliminary plan for the Rum River Hills P.U.D.; and WHEREAS, at its regular meeting on December 4, 1984, the City-'s Plan- ning and Zoning Commission found that the final P.U.D. was in substantial com- piiance with the plan it had given preliminary approval to on August 2, 1983; ahd ! W/qEREAS, the entire P.U.D. shall be subject to restrictive covenants and conditions in order to maintain the appearance of the development. NC~ ~tqEREFORE, BE IT RESOLVED BY ~E CITY COUNCIL OF qlqE CITY OF RAMSEY, ANOKA CC~3NTy, S~TE OF MINNESO~I~, as follows: 1) ~nat final approval of the Rum River Hills Planned Unit Develop- ment is hereby granted subject to the following: a) 5hat Rum River Hills Associates and City enter into a compre- hensive develo~ent agreement which agreement shall incorpo- rate all City Code requirements and City policy relating to a development of this nature; and b) That the Rum River Hills Planned Unit Development site be re- zoned to P.U.D.; and Resolution #84-240 Page 3 of 4 !
