Also Excepting therefrom that part of said South Half of the Northeast Quarter lying within said plat of Brookview Estates. AND WHEREAS, said application is made pursuant to City Code Chapter ~170.014G, Planned Unit DeveloDment; and WHEREAS, on the 2nd day of August, 1983, the Planning and Zoning Com- mission held a public hearing on the application for the P.U.D. and rezoning which public hearing was properly published in the City's legal newspaper on the 22nd day of July, 1983; and i WHEREAS, the City's Planning and Zoning Commission met on the 2nd day ilof August, 1983 at which time it reviewed the PoU.D. application and made a :~written recommendation to the City Council that the preliminary development plan for the P.U.D. be approved; and WHEREAS, at its regular City Council meeting on August 23, 1983, the City Council gave preliminary approval of the plan; and WHEREAS, at its regular City Council meeting held on November 13, 1984 the City Council adopted Resolution #84-223 which is a resolution approving the amended preliminary plan for the Rum River Hills P.U.D.; and WHEREAS, at its regular meeting on December 4, 1984, the City!s Plan- ning and Zoning Commission found that the final P.U.D. was in substantial com- pliance with the plan it had given preliminary approval to on August 2, 1983; and i WHERFAS, the entire P.U.D. shall be subject to restrictive covenants i and conditions in order to maintain the appearance of the development. NC~ ~!~EREFORE, BE IT RESOLVED BY T~E CITY COUNCIL OF ~lqE CITY OF RAMSEY, ANOKA COUNTY, S[5%TE OF MINNESOTA, as follows: 1) That final approval of the Rum River Hills Planned Unit Develop- ment is hereby granted subject to the following: b) I I I I I I I I I I I I I' I That Rum River Hills Associates and City enter into a compre- hensive develoi~nent agreement which agreement shall incorpo- rate all City Code requirements and City policy relating to a development of this nature; and That the Rum River Hills Planned Unit DeveloI~nent site be re- zoned to P.U.D.; and Resolution #84-240 Page 3 of 4
