feet; thence northeasterly along a tangential curve, concave <br />to the east~, having a radius of 383.21 feet and having a <br />total central angle of 92 degrees, 27 minutes, 24 seconds, <br />for a distance of 98.58 feet, more or less, to the South <br />line of the duly recorded plat of Brookview Estates and <br />there terminating. <br /> <br />Also Excepting therefrom that part of said South Half of the <br />Northeast Quarter lying within said plat of Brookview <br />Estates. <br /> <br /> AND WHEREAS, said application is made pursuant to City Code Chapter <br />~170.014G, Planned Unit DeveloDment; and <br /> <br /> WHEREAS, on the 2nd day of August, 1983, the Planning and Zoning Com- <br />mission held a public hearing on the application for the P.U.D. and rezoning <br />which public hearing was properly published in the City's legal newspaper on the <br />22nd day of July, 1983; and <br />i WHEREAS, the City's Planning and Zoning Commission met on the 2nd day <br />ilof August, 1983 at which time it reviewed the PoU.D. application and made a <br />:~written recommendation to the City Council that the preliminary development plan <br />for the P.U.D. be approved; and <br /> <br /> WHEREAS, at its regular City Council meeting on August 23, 1983, the <br />City Council gave preliminary approval of the plan; and <br /> <br /> WHEREAS, at its regular City Council meeting held on November 13, 1984 <br /> the City Council adopted Resolution #84-223 which is a resolution approving the <br /> amended preliminary plan for the Rum River Hills P.U.D.; and <br /> <br /> WHEREAS, at its regular meeting on December 4, 1984, the City!s Plan- <br />ning and Zoning Commission found that the final P.U.D. was in substantial com- <br />pliance with the plan it had given preliminary approval to on August 2, 1983; <br /> and <br /> <br />i WHERFAS, the entire P.U.D. shall be subject to restrictive covenants <br />i and conditions in order to maintain the appearance of the development. <br />NC~ ~!~EREFORE, BE IT RESOLVED BY T~E CITY COUNCIL OF ~lqE CITY OF RAMSEY, ANOKA <br />COUNTY, S[5%TE OF MINNESOTA, as follows: <br /> <br /> 1) That final approval of the Rum River Hills Planned Unit Develop- <br />ment is hereby granted subject to the following: <br /> <br />b) <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I' <br />I <br /> <br />That Rum River Hills Associates and City enter into a compre- <br />hensive develoi~nent agreement which agreement shall incorpo- <br />rate all City Code requirements and City policy relating to a <br />development of this nature; and <br /> <br />That the Rum River Hills Planned Unit DeveloI~nent site be re- <br />zoned to P.U.D.; and <br /> <br />Resolution #84-240 <br /> <br />Page 3 of 4 <br /> <br /> <br />
