by ordinance after a ~public hearing, affirmatively voted to <br />vacate that' certain area designated and dedicated as park in the <br />plat of White Pine Estates, contingent upon the execution of this <br />Develop~enti Agreement, and contingent upon the City Charter <br />requirementS~ as to the effective date of City Ordinances. A <br />certified ~opy of the City's ordinance, vacating the subject <br />property, When and if said ordinance becomes effective, shall be <br />made available to the Developer for recording. ~he Developer <br />shall cause to be obtained a quit claim deed from ~homas W. <br />Anderson and Paula E. Anderson, husband and wife, the dedicators <br />of said pa~,k and also the owners of 100% of the abutting property <br />on said pa~k, conveying all their right, title interest and <br />equity in and to said park, in fee, to the City. In addition, <br />pursuant to paragraph 3, Developer shall provide proof of escrow <br />of the sum iof $5100.00, representing a purchase price as noted <br /> <br />in paragra~h 3e below for the ultimate disposition of said park. <br /> <br /> c. D~Dation_of.
