Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer <br />and Peterson. !Voting No: None. <br /> <br />Case #3: Request for a Conditional Use Permit to Grade and Export <br /> !Soils; Case of Good Value Homes, Inc. <br /> <br />Zoning Admigistrator Frolik stated that City Council granted preliminary plat approval to <br />Chestnut Ridge 2nd Addition on August 22, 1994. The purpose of this project is to create <br />more attractiv~ building sites. The applicant is proposing to strip the topsoil, remove and <br />export approgimately 15,000 cubic yards of materials, and replace the topsoil. She <br />reported that! the Planning Commission conducted a public hearing regarding this <br />application. T~here were several residents present from the first phase of Chestnut Ridge to <br />the east, whose concerns were alleviated when informed by Mr. Peterson of Good Value <br />Homes that there would be no excavating in the wetlands and that there would be no more <br />u'ees removedlthan what was originally approved by the City Council at the preliminary plat <br />stage. Other rbsidents along the haul route were assured that Good Value is responsible for <br />leaving the ha~ul roads in a condition equal to what they were at the commencement of the <br />project. At t~is time, Mr. Peterson also amended his proposal for haul routes and stated <br />that the ingresls route would be the same as the egress route and traffic control measures <br />such as flag p~ersons or the use. of walkie talkies would be used to avoid a situation of <br />trucks meetir~'g on Sunfish Lake Drive. She noted that Mr. Peterson is present at the <br />meeting,rr <br /> <br />Motion by Coluncilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution g95-08-167 adopting Findings of Fact g0383 relating to Good Value's request <br />for a conditiorial use pemfit to grade and export soils. <br /> <br />Motion carrie~. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer, Beahen <br />and Peterson. !Voting No: None. <br /> <br />Motion by C~uncilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution #9~5-08-168 approving Good Value's request for a conditional use permit to <br />grade and expf0n soils and declaring terms of same. <br />Motion carried.
