Case #13: z Award of Contract for Improvement Project #95-13 Sewer and Water Extension for Ramsey Elementary School City Engineer Jankowski stated that the bids were opened for the Improvement Project ~95-13 which' involves the extension of sanitary sewer interceptor along Wetland #114P and waterma!n along County Road #5 to serve the Ramsey Elementary School, its expansion an~l the former Walter Scroggins property to the north and west of the school which is sch~uled for development in 1995 and 1996. Motion by Co~.. ncilmember Beahen and seconded by Councilmember Zimmerman to adopt Resolution gtY6-06-136 awarding construction contract for Improvement Project g05-13 to Barborossa &', Sons in the amount of $729,575.75. Case #14: 'Approval of Joint Powers Agreement to the Lower Rum River Watershed Management Organization City Engineer Jankowski presented Council with a background on watersheds and the watershed ma)agement organization. He reminded Council that a draft of an updated joint powers agree~nent was presented to them in May 1994. One of the most significant changes was ~e manner in which capital improvement projects are to be implemented and financed. Uniter the. existing JPA, each member city may decide, at its sole discretion, as to whether they wish to participate in a capital improvement project. The new legislation requires thcs9 discretionary options be replaced with mandatory participation if the improvement project is determined to be necessary to implement the goals of the watershed plan. Council3 had expressed concerns over the fairness of these mandatory requirements in view of the gact that Ramsey contributes 42% of the organization's operating budget. Suggested wording was drafted and discussed with representatives of other member cities, as well as t~e LRRWMO attorney who drafted the original and proposed updated agreement. Mr. Jankowski believed that, at this point, the draft has been revised to the satisfaction of both the WMO attorney and our own City Attorney. The main point of contention c~enters around the method which would be used to finance a capital improvement~project which may be found to be necessary by the WMO. He summarized the draft pres~ented. The proposed language modification changes the manner in which project costs vgould be distributed among the project beneficiaries if the members could not agree to the qlistribution through negotiation. In this event, the parties would agree to submit the m~tter to arbitration. City Attorney Goodrich stated he concurs with Mr. Jankowski's statements - it appears to be the best comPromise. Mayor Hardin commented on the amount of review this JPA has had. Motion by Co, uncilmember Beyer and seconded by Councilmember Zimmerman to adopt Resolution #9,5-06-137 approving and amending the Joint Powers Agreement for the City of Ramsey wiih the Lower Rum River Watershed Management Organization.
