City Staff recommends improving the existing <br />drainage on Andfie Street as a condition of this permit. Mr. Jankowski also advised that <br />neighboring ~sidents have expressed opposition to the modification for aesthetic reasons. <br /> <br />Councilmember Peterson inquired as to who would pay for the cost of improving the <br />drainage on ~ndrie Street. <br /> <br />Mr. Jankowslti replied it was Staffs recommendation to have the developer pay for such. <br /> <br />Dennis Peck,iDirector of Development for North Fork, Inc., responded that their proposal <br />neither adds Or subtracts from the existing drainage problem. He said that the situation has <br />existed for sgveral years and never became an issue until now. He stated he had no <br />confidence in being able to negotiate with the golf course for a drainage pond, explaining <br />that he has mit with the owners and they have concerns of their own. He agreed there was <br />a problem an41 would try to work with it to some extent, but he felt what the City Engineer <br />proposes is unfair since the current drainage plan was accepted by the City years ago. To <br />require a resolution Will stop the project, because it will take months to negotiate with the <br />golf course. Mr. Peck didn't feel the City has the ability to make such a requirement. <br /> <br />Jan Koshak, 115700 St. Andrew's Lane N.W. - stated she came before the Council five <br />years ago on ~he same issue and chose to move because of aesthetics. She chose to move <br />to Northfork because they have covenants, and she wonders why any plans are made at all <br />when the dev,'eloper can come in any time and change everything. She reaffirmed her <br />opposition to ~the request. <br /> <br />Mr. Peck advised that Northfork has an architectural review committee that is controlled by <br />the residents,[ however, the Planning Commission felt the committee's recommendations <br />cannot be enforced. Under Northfork's declarations, 2~1/2 story homes are allowed. To <br />raise the grade 6-8 feet, North Fork is willing to limit houses to splits and ramblers which <br />will have less!impact visually. He declared they are not totally rejecting the concerns of the <br />neighbors. <br /> <br />Bill Kingston, 15760 Andrie Street N.W. (Chairperson of Northfork's Architectural <br />Review ComJ'nittee) - advised that the committee met regarding the request but did not <br />address the drainage issue other than recommending that the City Engineer and the North <br />Fork enginee~ resolve the problem. From an architectural standpoint, he stated what exists <br />is fairly flat and straight lines and they now are proposing berms, which the committee is <br />not in favor c~f. He informed that the committee would like to see uniform building pads. <br />He explained they would like to limit the increase in elevation and suggest a gradual <br />increase in the driveway grade. <br /> <br />The City Council proceeded to review the Findings of Fact. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to adopt <br />Resolution 45-07-147 adopting Findings of Fact g0380 relating to North Fork's request <br />for a conditional use permit to grade and export soils in Northfork Links. <br /> <br />Motion carriett. Voting Yes: Councilmembers Zimmerman, Beahen, Beyer, and Peterson. <br />Voting No: lqone. Abstain: Mayor Hardin. <br /> <br />The City Council proceeded to review the terms of the permit. <br /> <br />Ms. Koshak oxpressed her concern regarding the steep grade of the driveways. <br /> <br />City Council/July 11, 1995 <br /> Page 5 of 13 <br /> <br /> <br />
