Water availability char~es are due and payable at the time property served by ~he wm~er u~ility is final plaEted into buildable 10ts. Waser connection charges are du~ and payable au the time of connection of a buildin9 to the water utility, or a~ the time cornlection i~ required to be mmda to the water utility pursuant to Section 130~.00. User char~es a~d rates are due and payable in such amounts and mt such times as required by Elk River Mtt~icip~l Utilities. Each charge and/or rate sh~ll be iu the amount established by duly adopted resolution of the Elk River City Council or Elk River Municipal U~iliEies. Ail properties connected to the City wa~er u~ility sh~ll abide by the rules and re~utazions of the Elk River Municipal Utilities, and shall pay all applicable waSer availabili%y charges, water connection char~es, user char~es and rates established by the City council and/or Elk River Municipal Utilities. Properties which are required to connect to the water utility pursuant to Section 1304.00, but have not connected within ~wo (2) years of availability of water sea-vice as required by Section 1304.00, shall be charged ~he applicable water availability charge, water connection charge and a monthly user charge in an amount estaJnlished by Elk River Mualicipal Utilities. 13.45
